Bu durumda ilk akla gelen sebep; fazla mesai yapt\u0131r\u0131lmas\u0131 ve fazla mesai \u00fccretlerinin \u00f6denmemesidir ki bu durumda i\u015f\u00e7i hakl\u0131 nedenle i\u015f akdini feshederek k\u0131dem tazminat\u0131n\u0131 talep edebilir. Buradaki fazla mesai; i\u015f g\u00fcnlerinde haftal\u0131k 45 saatlik azami s\u00fcrenin a\u015f\u0131lmas\u0131 \u015feklinde yapt\u0131r\u0131labilece\u011fi gibi ulusal ve genel bayram tatil g\u00fcnleri ve resm\u00ee tatil ile hafta tatilinde \u00e7al\u0131\u015fma yap\u0131lmas\u0131na kar\u015f\u0131l\u0131k \u00fccretin \u00f6denmemesi veya eksik \u00f6denmesi \u015feklinde de meydana gelebilir. Bu durumda fazla mesai \u00fccreti \u00f6denmeyen i\u015f\u00e7inin i\u015ften ayr\u0131l\u0131p k\u0131dem tazminat\u0131 talep etme hakk\u0131 bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Yaln\u0131zca fazla mesai \u00fccreti de\u011fil, normal \u00fccreti zaman\u0131nda ve tam \u00f6denmeyen i\u015f\u00e7ilerin de bu nedenle hakl\u0131 sebeple derhal fesih hakk\u0131 bulunmakta olup uygulamada s\u0131kl\u0131kla kar\u015f\u0131la\u015f\u0131ld\u0131\u011f\u0131 \u00fczere al\u0131nan \u00fccretin asgari \u00fccretten fazla olmas\u0131na ra\u011fmen SGK primlerinin asgari \u00fccretten veya oldu\u011fundan daha d\u00fc\u015f\u00fck yat\u0131r\u0131lmas\u0131 da i\u015f\u00e7iye hakl\u0131 nedenle fesih hakk\u0131 verir.<\/p>\n\n\n\n<p>\u0130\u015fverenin hakaretine veya onur k\u0131r\u0131c\u0131 davran\u0131\u015flar\u0131na maruz kal\u0131nmas\u0131, taciz, sistematik ve s\u00fcrekli psikolojik \u015fiddet (mobbing) uygulanmas\u0131 ya da i\u015f \u015fartlar\u0131nda i\u015f\u00e7inin onay\u0131 al\u0131nmaks\u0131z\u0131n esasl\u0131 de\u011fi\u015fiklik yap\u0131lmas\u0131 hallerinde de i\u015f\u00e7i kendisi i\u015ften ayr\u0131l\u0131rken dahi k\u0131dem tazminat\u0131n\u0131 talep edebilir.<\/p>\n\n\n\n<p>T\u00fcm bu durumlara ek olarak i\u015ften ayr\u0131lma \u015fekli ya da sebebi ne olursa olsun i\u015f\u00e7iler kendilerine \u00f6denmeyen maa\u015flar\u0131n\u0131, \u00f6denmeyen fazla mesai \u00fccretlerini, y\u0131ll\u0131k izin \u00fccretlerini i\u015f akdinin sonlanmas\u0131ndan itibaren 5 y\u0131ll\u0131k s\u00fcre\u00e7te isteyebilmektedir.
