Bir \u00e7al\u0131\u015fan\u0131n, i\u015fverenine belli bir s\u00fcre boyunca ba\u011fl\u0131l\u0131k g\u00f6stererek \u00e7al\u0131\u015ft\u0131ktan sonra i\u015f ili\u015fkisinin bitmesi durumunda, i\u015f\u00e7iye bu hizmet s\u00fcresine dayanarak \u00f6denen bir tazminatt\u0131r. K\u0131dem tazminat\u0131, i\u015f\u00e7inin i\u015ften ayr\u0131lma nedenine ba\u011fl\u0131 olarak hesaplama y\u00f6ntemlerine tabi olabilir ve i\u015f\u00e7inin hizmet s\u00fcresi, k\u0131dem tazminat\u0131n\u0131n miktar\u0131n\u0131 belirleyen temel bir fakt\u00f6rd\u00fcr. Bu hak, i\u015fverenin yasal ve s\u00f6zle\u015fmeye dayal\u0131 y\u00fck\u00fcml\u00fcl\u00fcklerine dayan\u0131r ve i\u015f kanunlar\u0131 veya i\u015f s\u00f6zle\u015fmeleri taraf\u0131ndan belirlenen ko\u015fullara g\u00f6re hesaplan\u0131r ve \u00f6denir. \u0130\u015f\u00e7inin son ald\u0131\u011f\u0131 \u00fccrete yol, yeme, sosyal yard\u0131m vb. haklar d\u00e2hil edilerek ortaya \u00e7\u0131kan giydirilmi\u015f br\u00fct \u00fccret \u00fczerinden hesaplanarak \u00f6denir.<\/p>\n\n\n\n<p><strong>4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019na G\u00f6re \u0130\u015f\u00e7i<\/strong><\/p>\n\n\n\n<p>Y\u00fcr\u00fcrl\u00fcl\u00fckte bulunan 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na g\u00f6re i\u015f s\u00f6zle\u015fmesi ile bir ki\u015finin (t\u00fczel veya ger\u00e7ek) yan\u0131nda \u00e7al\u0131\u015fan ki\u015fiye i\u015f\u00e7i denilmektedir. Bu s\u00f6zle\u015fme yaz\u0131l\u0131 ve s\u00f6zl\u00fc olabilmektedir. Ayr\u0131ca ayn\u0131 kanunun 14. Maddesi gere\u011fince a\u015fa\u011f\u0131da belirtmi\u015f oldu\u011fumuz mesleklerde \u00e7al\u0131\u015fan ki\u015filer i\u015f\u00e7i stat\u00fcs\u00fcnde de\u011ferlendirilmedi\u011fi i\u00e7in bu ki\u015filer k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131rlar.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deniz ta\u015f\u0131ma i\u015f\u00e7ileri,<\/li>\n\n\n\n<li>Hava ta\u015f\u0131ma i\u015f\u00e7ileri,<\/li>\n\n\n\n<li>Elli ve ellinin alt\u0131nda i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran Tar\u0131m ve Orman \u0130\u015flerinin yap\u0131ld\u0131\u011f\u0131 i\u015fyerleri,<\/li>\n\n\n\n<li>Aile ekonomisi i\u00e7erisinde kalan tar\u0131mla ilgili her \u00e7e\u015fit yap\u0131 i\u015fleri,<\/li>\n\n\n\n<li>Ev hizmetleri,<\/li>\n\n\n\n<li>\u00c7\u0131raklar,<\/li>\n\n\n\n<li>Sporcular,<\/li>\n\n\n\n<li>Rehabilite edilenler,<\/li>\n\n\n\n<li>Esnaf ve Sanatkarlar Kanunu madde 2\u2019deki belirtilen \u015fartlara g\u00f6re \u00fc\u00e7 ve daha az i\u015f\u00e7inin bulundu\u011fu i\u015fyerlerinde \u00e7al\u0131\u015fanlar,<\/li>\n<\/ul>\n\n\n\n<p>i\u015f\u00e7i stat\u00fcs\u00fcnde de\u011ferlendirilmedi\u011fi i\u00e7in i\u015f kanununa tabi de\u011fildirler. Dolay\u0131s\u0131yla k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131rlar.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 9. Hukuk Dairesi 2016\/18788 E. 2020\/4087 K. ve 10.03.2020 tarihli karar\u0131nda<\/strong> <em>\u201c4857 say\u0131l\u0131 \u0130\u015f Kanunu i\u015f\u00e7i tan\u0131m\u0131na ikinci maddesinde yer vermi\u015ftir. Buna g\u00f6re bir i\u015f s\u00f6zle\u015fmesine dayanarak \u00e7al\u0131\u015fan ger\u00e7ek ki\u015fiye i\u015f\u00e7i denir.\u201d <\/em>\u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<p><strong>K\u0131dem Tazminat\u0131na Hak Kazanabilmenin Ko\u015fullar\u0131<\/strong><\/p>\n\n\n\n<p><strong>1- En Az Bir Y\u0131ll\u0131k K\u0131dem S\u00fcresi<\/strong><\/p>\n\n\n\n<p>\u0130\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in ayn\u0131 i\u015fverenin i\u015f yeri veya i\u015fyerlerinde en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmal\u0131d\u0131r. Bu \u015fart\u0131 sa\u011flamad\u0131\u011f\u0131 durumlarda i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131r. \u0130\u015f\u00e7i bir y\u0131ldan az \u00e7al\u0131\u015fmas\u0131 durumunda k\u0131dem tazminat\u0131na hak kazanamazken bir y\u0131ldan sonra \u00e7al\u0131\u015ft\u0131\u011f\u0131 her g\u00fcn i\u00e7in k\u0131dem tazminat\u0131n\u0131 alabilmektedir. Yani 1 y\u0131l 1 ay \u00e7al\u0131\u015fan bir i\u015f\u00e7i 13 ayl\u0131k k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r.<\/p>\n\n\n\n<p><strong>2- \u0130\u015f S\u00f6zle\u015fmesinin Sona Ermesi<\/strong><\/p>\n\n\n\n<p>\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in yukar\u0131da da bahsetmi\u015f oldu\u011fumuz gibi i\u015f\u00e7i ile i\u015fveren aras\u0131nda yaz\u0131l\u0131 veya s\u00f6zl\u00fc bir i\u015f s\u00f6zle\u015fmesi olmas\u0131 gerekmektedir. Bu s\u00f6zle\u015fmeler belirli veya belirsiz s\u00fcreli olarak yap\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Belirli s\u00fcreli i\u015f s\u00f6zle\u015fmeleri, niteli\u011fine uygun olarak belirli i\u015flerde veyahut belli bir i\u015fin tamamlanmas\u0131 i\u00e7in yap\u0131lan bu s\u00f6zle\u015fmeler olup i\u015fin bitmesiyle veyahut s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan \u015fart\u0131n ger\u00e7ekle\u015fmesiyle kendili\u011finden sona ermektedir. Dolay\u0131s\u0131yla bu s\u00f6zle\u015fme t\u00fcrlerinde i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131r.<\/p>\n\n\n\n<p>Belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise, i\u015f\u00e7inin s\u00f6zle\u015fmeyi hakl\u0131 nedenle veya i\u015fverenin haks\u0131z bir nedenle feshetmesi durumunda m\u00fclga 1475 Say\u0131l\u0131 Kanun\u2019un 14. Maddesindeki ko\u015fullar do\u011frultusunda i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanabilmektedir.<\/p>\n\n\n\n<p><strong>\u0130\u015fveren Taraf\u0131ndan Fesih Durumlar\u0131<\/strong><\/p>\n\n\n\n<p>\u0130\u015f Kanunu madde 25\u2019in 2. bendinde yer alan belirli haller d\u0131\u015f\u0131nda i\u015f s\u00f6zle\u015fmesinin i\u015fveren taraf\u0131ndan feshedilmesi durumunda i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r. Bu haller ise \u015funlard\u0131r:<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>\u0130\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri i\u00e7in gerekli vas\u0131flar veya \u015fartlar kendisinde bulunmad\u0131\u011f\u0131 halde bunlar\u0131n kendisinde bulundu\u011funu ileri s\u00fcrerek, yahut ger\u00e7e\u011fe uygun olmayan bilgiler veya s\u00f6zler s\u00f6yleyerek i\u015f\u00e7inin i\u015fvereni yan\u0131ltmas\u0131.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin, i\u015fveren yahut bunlar\u0131n aile \u00fcyelerinden birinin \u015feref ve namusuna dokunacak s\u00f6zler sarf etmesi veya davran\u0131\u015flarda bulunmas\u0131, yahut i\u015fveren hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z ihbar ve isnatlarda bulunmas\u0131.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131, i\u015fyerine sarho\u015f yahut uyu\u015fturucu madde alm\u0131\u015f olarak gelmesi ya da i\u015fyerinde bu maddeleri kullanmas\u0131.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na iki i\u015fg\u00fcn\u00fc veya bir ay i\u00e7inde iki defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc, yahut bir ayda \u00fc\u00e7 i\u015fg\u00fcn\u00fc i\u015fine devam etmemesi.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/li>\n<\/ul>\n\n\n\n<ol style=\"list-style-type:lower-roman\" class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi, i\u015fyerinin mal\u0131 olan veya mal\u0131 olmay\u0131p da eli alt\u0131nda bulunan makineleri, tesisat\u0131 veya ba\u015fka e\u015fya ve maddeleri otuz g\u00fcnl\u00fck \u00fccretinin tutar\u0131yla \u00f6deyemeyecek derecede hasara ve kayba u\u011fratmas\u0131.<\/li>\n<\/ol>\n\n\n\n<p>Bu hallerin olu\u015fmas\u0131 durumuna dayanarak i\u015fverenin i\u015f s\u00f6zle\u015fmesini feshetmesi durumunda i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131r. Bu haller d\u0131\u015f\u0131nda i\u015fveren taraf\u0131ndan i\u015f s\u00f6zle\u015fmesinin sonland\u0131r\u0131lmas\u0131 durumunda ise i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r. \u0130\u015f akdinin k\u0131dem tazminat\u0131 do\u011furmayacak \u015fekilde feshedildi\u011fine dair ispat y\u00fck\u00fc i\u015fverendedir.<\/p>\n\n\n\n<p><strong>\u0130\u015f\u00e7i Taraf\u0131ndan Fesih Durumlar\u0131<\/strong><\/p>\n\n\n\n<p>\u0130\u015f\u00e7i i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle sonland\u0131rm\u0131\u015fsa k\u0131dem tazminat\u0131 almaya hak kazanm\u0131\u015f demektir. Hakl\u0131 neden d\u0131\u015f\u0131nda kalan sebeplere dayanarak yap\u0131lan fesih durumunda i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamamaktad\u0131r. Bu hakl\u0131 sebepler;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Sa\u011fl\u0131k Sebepleri:<\/strong><\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>\u0130\u015f s\u00f6zle\u015fmesinin konusu olan i\u015fin yap\u0131lmas\u0131 i\u015fin niteli\u011finden do\u011fan bir sebeple i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 veya ya\u015fay\u0131\u015f\u0131 i\u00e7in tehlikeli olursa.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa.<\/li>\n<\/ul>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Ahlak ve \u0130yi Niyet Kurallar\u0131na Uymayan Haller Ve Benzerleri:<\/strong><\/li>\n<\/ol>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>\u0130\u015fveren i\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri hakk\u0131nda yanl\u0131\u015f vas\u0131flar veya \u015fartlar g\u00f6stermek yahut ger\u00e7e\u011fe uygun olmayan bilgiler vermek veya s\u00f6zler s\u00f6ylemek suretiyle i\u015f\u00e7iyi yan\u0131lt\u0131rsa.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00a0\u0130\u015fveren i\u015f\u00e7inin veya ailesi \u00fcyelerinden birinin \u015feref ve namusuna dokunacak \u015fekilde s\u00f6zler s\u00f6yler, davran\u0131\u015flarda bulunursa veya i\u015f\u00e7iye cinsel tacizde bulunursa.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015fveren i\u015f\u00e7iye veya ailesi \u00fcyelerinden birine kar\u015f\u0131 sata\u015fmada bulunur veya g\u00f6zda\u011f\u0131 verirse, yahut i\u015f\u00e7iyi veya ailesi \u00fcyelerinden birini kanuna kar\u015f\u0131 davran\u0131\u015fa \u00f6zendirir, k\u0131\u015fk\u0131rt\u0131r, s\u00fcr\u00fckler, yahut i\u015f\u00e7iye ve ailesi \u00fcyelerinden birine kar\u015f\u0131 hapsi gerektiren bir su\u00e7 i\u015flerse yahut i\u015f\u00e7i hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z a\u011f\u0131r isnat veya ithamlarda bulunursa.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015f\u00e7inin di\u011fer bir i\u015f\u00e7i veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan i\u015fyerinde cinsel tacize u\u011framas\u0131 ve bu durumu i\u015fverene bildirmesine ra\u011fmen gerekli \u00f6nlemler al\u0131nmazsa.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin \u00fccreti kanun h\u00fck\u00fcmleri veya s\u00f6zle\u015fme \u015fartlar\u0131na uygun olarak hesap edilmez veya \u00f6denmezse.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00dccretin par\u00e7a ba\u015f\u0131na veya i\u015f tutar\u0131 \u00fczerinden \u00f6denmesi kararla\u015ft\u0131r\u0131l\u0131p da i\u015fveren taraf\u0131ndan i\u015f\u00e7iye yapabilece\u011fi say\u0131 ve tutardan az i\u015f verildi\u011fi hallerde, aradaki \u00fccret fark\u0131 zaman esas\u0131na g\u00f6re \u00f6denerek i\u015f\u00e7inin eksik ald\u0131\u011f\u0131 \u00fccret kar\u015f\u0131lanmazsa, yahut \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmazsa.<\/li>\n<\/ul>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>\u00a0Zorlay\u0131c\u0131 Sebepler:<\/strong><\/li>\n<\/ol>\n\n\n\n<p>\u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131karsa i\u015f\u00e7i k\u0131dem tazminat\u0131na hak ederek i\u015ften ayr\u0131labilir.<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>\u0130\u015f\u00e7inin Vefat\u0131 Durumunda:<\/strong><\/li>\n<\/ol>\n\n\n\n<p>S\u00f6zle\u015fme, i\u015f\u00e7inin \u00f6l\u00fcm\u00fc ile kendili\u011finden sona ermektedir. \u0130\u015fveren, i\u015f\u00e7inin sa\u011f kalan e\u015fi veya ergin olmayan \u00e7ocuklar\u0131na, yoksa bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filere, \u00f6l\u00fcm g\u00fcn\u00fcnden ba\u015flayarak bir ayl\u0131k; hizmet ili\u015fkisi be\u015f y\u0131ldan uzun bir s\u00fcre devam etmi\u015fse, iki ayl\u0131k bir \u00fccret tutar\u0131nda bir \u00f6deme yapmakla y\u00fck\u00fcml\u00fcd\u00fcr. Bunun yan\u0131nda \u0130\u015f Kanunu madde 14 gere\u011fince de bir y\u0131ll\u0131k \u00e7al\u0131\u015fma \u015fart\u0131n\u0131 sa\u011flayan i\u015f\u00e7inin \u00f6l\u00fcm\u00fc durumunda k\u0131dem tazminat\u0131 \u00f6demesi miras\u00e7\u0131lar\u0131na yap\u0131lmak zorundad\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Muvazzaf Askerlik Durumunda:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Muvazzaf askerlik \u00f6devi d\u0131\u015f\u0131nda manevra veya herhangi bir sebeple silah alt\u0131na al\u0131nan veyahut herhangi bir kanundan do\u011fan \u00e7al\u0131\u015fma \u00f6devi y\u00fcz\u00fcnden i\u015finden ayr\u0131lan i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesi i\u015finden ayr\u0131ld\u0131\u011f\u0131 g\u00fcnden ba\u015flayarak iki ay sonra i\u015fverence feshedilmi\u015f say\u0131l\u0131r. Dolay\u0131s\u0131yla bir y\u0131ll\u0131k \u00e7al\u0131\u015fma s\u00fcresini doldurmu\u015f olan i\u015f\u00e7iler askerlik sebebi ile i\u015ften ayr\u0131lmas\u0131 durumunda k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Emeklilik (Ya\u015fl\u0131l\u0131k Ayl\u0131\u011f\u0131) Durumunda:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u0130\u015f\u00e7i emekli olmas\u0131n\u0131 gerek\u00e7e g\u00f6stererek i\u015f s\u00f6zle\u015fmesini feshedebilmektedir. Ancak emekli olmas\u0131 sonucunda, kurum veya sand\u0131klardan ya\u015fl\u0131l\u0131k, emeklilik ayl\u0131\u011f\u0131 ba\u011fland\u0131\u011f\u0131na dair yaz\u0131y\u0131 i\u015fverene bildirdi\u011fi durumlarda k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 9. Hukuk Dairesi 2008\/12537 E. 2009\/23242 K. 17.09.2009 tarihli karar\u0131nda<\/strong> <em>\u2018\u2019\u0130\u015f\u00e7inin, sosyal g\u00fcvenlik anlam\u0131nda bu hakk\u0131 kazanmas\u0131n\u0131n ard\u0131ndan ilgili kurum ya da sand\u0131\u011fa ba\u015fvurmaks\u0131z\u0131n k\u0131dem tazminat\u0131 talebiyle i\u015fyerinden ayr\u0131lmas\u0131 ve bu yolla hakk\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmi\u015f olur. \u0130\u015f\u00e7i taraf\u0131ndan ba\u011fl\u0131 bulundu\u011fu kurum ya da sand\u0131ktan tahsise ya da tahsis yap\u0131labilece\u011fine daire yaz\u0131n\u0131n i\u015fverene bildirildi\u011fi anda i\u015fverenin k\u0131dem tazminat\u0131 \u00f6deme y\u00fck\u00fcm\u00fc do\u011far ve faiz ba\u015flang\u0131c\u0131 da bu tarih olarak esas al\u0131nmal\u0131d\u0131r.\u2019\u2019<\/em> \u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kad\u0131n \u0130\u015f\u00e7inin Evlenmesi Durumunda:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>1475 Say\u0131l\u0131 Kanunda d\u00fczenlenen h\u00fckme g\u00f6re, sadece kad\u0131n i\u015f\u00e7iler a\u00e7\u0131s\u0131ndan ge\u00e7erli olmak kayd\u0131yla i\u015f\u00e7inin evlilik sebebiyle i\u015f s\u00f6zle\u015fmesini sonland\u0131rmas\u0131 durumunda, k\u0131dem tazminat\u0131 hakk\u0131 do\u011facakt\u0131r. Ancak burada dikkat edilmesi gereken s\u00fcreler mevcuttur. \u0130\u015f\u00e7inin, evlendi\u011fi tarihten ba\u015flayan s\u00fcre ile bir y\u0131l i\u00e7erisinde i\u015f akdini sonland\u0131rmas\u0131 gerekmektedir. Bir y\u0131ldan sonra yap\u0131lan sonland\u0131rmalarda k\u0131dem tazminat\u0131na hak kazanamayacakt\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sendika Y\u00f6neticili\u011fi Durumunda:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>\u0130\u015f\u00e7i, sendika y\u00f6neticisi olmas\u0131 durumunda, dilerse i\u015f s\u00f6zle\u015fmesini ask\u0131ya alabilmektedir. Ancak ask\u0131ya almaz ve s\u00f6zle\u015fmeyi sonland\u0131r\u0131rsa k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7i, sendika y\u00f6neticisi olduktan ve i\u015f s\u00f6zle\u015fmesini ask\u0131ya ald\u0131ktan sonra, sendika g\u00f6revini b\u0131rakmas\u0131 veyahut g\u00f6revin bitmesi durumunda ask\u0131da olan s\u00f6zle\u015fmeyi y\u00fcr\u00fcrl\u00fc\u011fe koyarak tekrar i\u015fe d\u00f6nmeyi isteyebilmektedir. Buna ra\u011fmen i\u015fveren bu iste\u011fi kabul etmeyip i\u015f\u00e7iyi tekrar i\u015fe almaz ise de i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanmaktad\u0131r.<\/p>\n\n\n\n<p><strong>K\u0131dem Tazminat\u0131n\u0131n Hesaplanmas\u0131<\/strong><\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131 hesaplan\u0131rken s\u00fcre ba\u015flang\u0131c\u0131 olarak i\u015fe ba\u015flama tarihi al\u0131nmaktad\u0131r. Ancak i\u015f\u00e7i i\u015fe haz\u0131r bulunmas\u0131na ra\u011fmen, t\u00fcrl\u00fc sebeplerle i\u015fe ba\u015flat\u0131lmamas\u0131 durumunda ge\u00e7en s\u00fcrede de \u00e7al\u0131\u015fm\u0131\u015f say\u0131laca\u011f\u0131ndan s\u00fcre ba\u015flang\u0131c\u0131 olarak i\u015f\u00e7inin, i\u015fverenin buyru\u011funa haz\u0131r bulundu\u011fu tarih kabul edilmektedir. Deneme s\u00fcreli i\u015f s\u00f6zle\u015fmesinin yap\u0131lm\u0131\u015f olmas\u0131 durumunda deneme s\u00fcresi de \u00e7al\u0131\u015fma s\u00fcresine d\u00e2hil edilmektedir.<\/p>\n\n\n\n<p>Hesaplanacak s\u00fcrenin son g\u00fcn\u00fc, s\u00fcresiz fesih bildirimi ile s\u00f6zle\u015fme sona ermi\u015fse bildirimin vard\u0131\u011f\u0131 g\u00fcn, s\u00fcreli fesih bildirimi ile s\u00f6zle\u015fme sona ermi\u015fse s\u00fcrenin bitti\u011fi g\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>K\u0131dem tazminat\u0131 hesab\u0131 yap\u0131l\u0131rken hesaba al\u0131nacak \u00fccret, i\u015f\u00e7inin alm\u0131\u015f oldu\u011fu son \u00fccretidir.
