Yani kiralan\u0131n sahibi kendi ihtiyac\u0131 sebebiyle tahliye davas\u0131 a\u00e7abilece\u011fi gibi yukar\u0131da say\u0131lan ki\u015filerin ihtiyac\u0131 sebebiyle de tahliye davas\u0131 a\u00e7ma hakk\u0131na sahiptir. Bu ki\u015filer d\u0131\u015f\u0131nda birilerinin ihtiyac\u0131 sebebiyle kirac\u0131n\u0131n tahliyesi m\u00fcmk\u00fcn olmamaktad\u0131r.<\/li>\n\n\n\n<li>Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imkans\u0131z ise kiralan\u0131n tahliyesini istemek m\u00fcmk\u00fcn olmaktad\u0131r.<\/li>\n<\/ul>\n\n\n\n<p>Belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirim i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sonra erdirebilir.<\/p>\n\n\n\n<p>Yani kira s\u00f6zle\u015fmesi belirli s\u00fcreli ise kiraya veren ancak kira s\u00f6zle\u015fmesinin s\u00fcresinin bitiminden itibaren bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile kirac\u0131n\u0131n tahliyesin isteyebilir.<\/p>\n\n\n\n<p>Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde ise, ihtiya\u00e7 sebebiyle tahliye davas\u0131 a\u00e7maki\u00e7in alt\u0131 ayl\u0131k fesih d\u00f6nemisona ermesinden itibaren en az \u00fc\u00e7 ay \u00f6ncesine kadar kirac\u0131ya ihtarname g\u00f6nderilmesi gerekmektedir.<\/p>\n\n\n\n<p><strong>Ta\u015f\u0131nmaz ihtiyac\u0131 ger\u00e7ek ve samimi olmal\u0131d\u0131r<\/strong><\/p>\n\n\n\n<p>Kiralanan\u0131n ihtiya\u00e7 (gereksinim) sebebiyle tahliye edilebilmesi i\u00e7in TBK m. 350 ve 351\u2019de d\u00fczenlendi\u011fi \u00fczere ihtiyac\u0131n, ger\u00e7ek, samimi, s\u00fcrekli ve zorunlu olmas\u0131 gerekmektedir. Devaml\u0131l\u0131\u011f\u0131 bulunmayan, hen\u00fcz do\u011fmam\u0131\u015f veya ger\u00e7ekle\u015fmesi i\u00e7in uzun bir s\u00fcre gereken ihtiya\u00e7lar tahliye sebebi olu\u015fturmaz. Bu ihtiya\u00e7 nedenlerinin dava a\u00e7\u0131l\u0131rken bulunmas\u0131 gerekli oldu\u011fu gibi yarg\u0131lama s\u00fcresince de mevcut olmas\u0131 yani devam etmesi gerekir.<\/p>\n\n\n\n<p>Bu ihtiya\u00e7 sebeplerine, kiraya verenin kirada oturmas\u0131, kiraya verenin \u00e7ocuklar\u0131n\u0131n e\u011fitim sebebi ile kiralanan\u0131n bulundu\u011fu \u015fehre yerle\u015fmesi, kiraya verenin oturmu\u015f oldu\u011fu konutun art\u0131k gereksinimlerini kar\u015f\u0131lamamas\u0131 gibi durumlar \u00f6rnek g\u00f6sterilebilir.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Yarg\u0131tay&nbsp; 6. Hukuk Dairesi E: 2014\/3336 K:2014\/4259, say\u0131l\u0131 karar\u0131nda<\/strong> \u2018\u2019Konut ihtiyac\u0131na dayal\u0131 davalarda ihtiya\u00e7l\u0131n\u0131n kirada oturmas\u0131 ihtiyac\u0131n varl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan yeterlidir. Davac\u0131n\u0131n kirada oturdu\u011fu konusunda uyu\u015fmazl\u0131k bulunmad\u0131\u011f\u0131na g\u00f6re ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kabul\u00fc ile daval\u0131n\u0131n tahliyesine karar vermek gerekir.\u2019\u2019 \u015eeklinde h\u00fck\u00fcm kurmu\u015ftur.<\/h1>\n\n\n\n<p><strong>Dava S\u00fcresinin Uzamas\u0131<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kiraya veren, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r. \u00d6rnek vermek gerekirse; kira s\u00f6zle\u015fmesi 10 May\u0131s 2023 tarihinde imzalanm\u0131\u015f ve bir y\u0131ll\u0131k ise ihtiya\u00e7 nedeniyle tahliye davas\u0131, 10 May\u0131s 2024&nbsp; tarihinden itibaren 1 ay i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r. Ancak 10 May\u0131s 2024 tarihine kadar e\u011fer tahliye talep edilece\u011fine dair kirac\u0131ya ihtarname g\u00f6nderilip tebli\u011f edilmi\u015f olursa, tahliye davas\u0131 a\u00e7ma s\u00fcresi 10 May\u0131s 2024\u2019ten 10 May\u0131s 2025\u2019e kadar olan bir kira y\u0131l\u0131 i\u00e7in uzar. Bu s\u00fcreler her kira y\u0131l\u0131 i\u00e7in ayr\u0131 ayr\u0131 ge\u00e7erlidir.<\/p>\n\n\n\n<p><strong>\u00d6zel Bir Hak Olarak; Yeni Malikin Gereksinimi Sebebiyle Tahliye Talebi;<\/strong><\/p>\n\n\n\n<p>Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir dava ile sona erdirebilir. <em>(S\u00fcreler konusunda detayl\u0131 bilgi i\u00e7in bkz: Kira Hukukunda S\u00fcreler Ba\u015fl\u0131kl\u0131 Yaz\u0131m\u0131z)<\/em><\/p>\n\n\n\n<p>Kiralanan\u0131 sonradan edinen ki\u015fi dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir. Bu durumda yeni malik, s\u00f6zle\u015fme gere\u011fi ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131\u011f\u0131nda kira s\u00f6zle\u015fmesinin taraf\u0131 haline geldi\u011finden yani ta\u015f\u0131nmaz\u0131 edinmesiyle birlikte \u201ckiraya veren\u201d s\u0131fat\u0131n\u0131 kazand\u0131\u011f\u0131ndan, yukar\u0131daki 6 ayl\u0131k s\u00fcre verip tahliye talep etmek hakk\u0131na ek olarak s\u00f6zle\u015fme s\u00fcresinin bitiminden \u2013veya&nbsp; her uzama y\u0131l\u0131n\u0131n bitiminden itibaren- bir ay i\u00e7inde a\u00e7aca\u011f\u0131 davayla ta\u015f\u0131nmaz\u0131n tahliyesini talep edebilir.<\/p>\n\n\n\n<p><strong>Yeniden kiralama yasa\u011f\u0131<\/strong><\/p>\n\n\n\n<p>Kiraya veren, gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz.<\/p>\n\n\n\n<p>Yeniden in\u015fa ve imar amac\u0131yla bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar, eski h\u00e2li ile, hakl\u0131 sebep olmaks\u0131z\u0131n \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e ba\u015fkas\u0131na kiralanamaz.<\/p>\n\n\n\n<p>Eski kirac\u0131n\u0131n, yeniden in\u015fa ve imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazlar\u0131, yeni durumu ve yeni kira bedeli ile kiralama konusunda \u00f6ncelik hakk\u0131 vard\u0131r. Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131bildirimi izleyen bir ay i\u00e7inde kullan\u0131lmas\u0131 gerekir; bu \u00f6ncelik hakk\u0131 sona erdirilmedik\u00e7e, ta\u015f\u0131nmaz \u00fc\u00e7 y\u0131l ge\u00e7meden ba\u015fkas\u0131na kiralanamaz.<\/p>\n\n\n\n<p>Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<p><strong>Dava s\u00fcresinin uzamas\u0131<\/strong><\/p>\n\n\n\n<p>Kiraya veren, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r. \u00d6rnek vermek gerekirse; kira s\u00f6zle\u015fmesi 10 May\u0131s 2023 tarihinde imzalanm\u0131\u015f ve bir y\u0131ll\u0131k ise ihtiya\u00e7 nedeniyle tahliye davas\u0131, 10 May\u0131s 2024&nbsp; tarihinden itibaren 1 ay i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r. Ancak 10 May\u0131s 2024 tarihine kadar e\u011fer tahliye talep edilece\u011fine dair kirac\u0131ya ihtarname g\u00f6nderilip tebli\u011f edilmi\u015f olursa, tahliye davas\u0131 a\u00e7ma s\u00fcresi 10 May\u0131s 2024\u2019ten 10 May\u0131s 2025\u2019e kadar olan bir kira y\u0131l\u0131 i\u00e7in uzar. Bu s\u00fcreler her kira y\u0131l\u0131 i\u00e7in ayr\u0131 ayr\u0131 ge\u00e7erlidir.<\/p>\n\n\n\n<p><strong>Yetkili ve g\u00f6revli mahkeme<\/strong><\/p>\n\n\n\n<p>\u0130htiya\u00e7 nedeniyle tahliye davas\u0131nda g\u00f6revli ve yetkili mahkeme, s\u00f6zle\u015fmenin ifa yerindeki veya daval\u0131n\u0131n yerle\u015fim yerindeki veya ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki Sulh Hukuk Mahkemesidir.<\/p>\n\n\n\n<p><strong>Zorunlu Arabuluculuk \u015eart\u0131<\/strong><\/p>\n\n\n\n<p>01.09.2023 tarihinden itibaren a\u00e7\u0131lacak ihtiya\u00e7 sebebiyle tahliye davalar\u0131nda dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurmak dava \u015fart\u0131 haline gelmi\u015ftir.
