Bir giyim e\u015fyas\u0131n\u0131n veya ziynet e\u015fyas\u0131n\u0131n \u00e7ok k\u0131sa s\u00fcre ile kiralanmas\u0131ndan g\u00fcnl\u00fck veya uzun d\u00f6nemlik hatta saatlik ara\u00e7 kiralamalar\u0131na kadar t\u00fcm kira ili\u015fkileri genel anlamda T\u00fcrk Bor\u00e7lar Kanunu\u2019nun d\u00f6rd\u00fcnc\u00fc b\u00f6l\u00fcm\u00fcndeki \u201cKira S\u00f6zle\u015fmesi\u201d k\u0131sm\u0131nda d\u00fczenlenmektedir.<\/p>\n\n\n\n<p>Ancak bu \u00e7al\u0131\u015fmam\u0131zda g\u00fcnden g\u00fcne uygulamada soru ve sorunlar\u0131 artan, bar\u0131nma gibi en temel ihtiya\u00e7lardan birisine dair olan ve kira hukukuna ili\u015fkin uyu\u015fmazl\u0131klar\u0131n hat\u0131r\u0131 say\u0131l\u0131r bir b\u00f6l\u00fcm\u00fcn\u00fcn kayna\u011f\u0131 olan Konut ve \u00c7at\u0131l\u0131 \u0130\u015fyeri Kiralar\u0131 \u00f6zelinde s\u00fcrelere de\u011finilecektir.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>S\u00f6zle\u015fme S\u00fcresi<\/strong><\/li>\n<\/ol>\n\n\n\n<p>S\u00f6zle\u015fme s\u00fcresi belirli veya belirsiz olabilir. Kanunun ifadesiyle <em>\u201cKararla\u015ft\u0131r\u0131lan s\u00fcrenin ge<\/em><em>\u00e7mesiyle herhangi bir bildirim olmaks\u0131z\u0131n sona erecek kira s<\/em><em>\u00f6zle\u015fmesi belirli s\u00fcrelidir; di\u011fer kira s<\/em><em>\u00f6zle\u015fmeleri belirli olmayan bir s\u00fc<\/em><em>re i<\/em><em>\u00e7in yap\u0131lm\u0131\u015f say\u0131l\u0131r\u201d<\/em> <strong><em><u>(TBK m. 300)<\/u><\/em><\/strong><\/p>\n\n\n\n<p><strong>2. Kiralananda Ay\u0131p Ortaya \u00c7\u0131kmas\u0131 Halinde S\u00fcre<\/strong><\/p>\n\n\n\n<p>Bu durumda T\u00fcrk Bor\u00e7lar Kanunu <strong><em>(Kanun, TBK),<\/em><\/strong>kiralanan\u0131n sonradan ay\u0131pl\u0131 hale gelmesi halinde kirac\u0131n\u0131n kiralayandan \u201cuygun bir s\u00fcre i\u00e7erisinde\u201d ay\u0131b\u0131n giderilmesini isteyebilece\u011fini belirtmekle yetinmi\u015ftir<strong><em><u> (TBK m. 306)<\/u><\/em><\/strong><\/p>\n\n\n\n<p><br>Ay\u0131b\u0131n ve somut durumun niteli\u011fine g\u00f6re her olay i\u00e7in ayr\u0131 ayr\u0131 hakkaniyet tespiti yapmak gerekti\u011finden burada \u201cmakul ve ortalama zekada bir insan\u0131n idrak kapasitesine g\u00f6re\u201d, d\u00fcr\u00fcstl\u00fck kural\u0131na uygun bir s\u00fcre belirlenmesi yerinde olacakt\u0131r. Nitekim Yarg\u0131tay da yerle\u015fik uygulamas\u0131nda ay\u0131b\u0131n ve somut durumun \u015fartlar\u0131na g\u00f6re ay\u0131b\u0131n giderilmesi i\u00e7in bir s\u00fcre verilmesini uygun bulmaktad\u0131r. Ay\u0131b\u0131n giderilmemesi halinde kirac\u0131n\u0131n s\u00f6zle\u015fmeyi feshetme ve varsa zarar ve ziyan\u0131n\u0131 talep etme hakk\u0131 olacakt\u0131r. Burada ay\u0131p bildiriminin ispat \u015fart\u0131 olarak yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 faydal\u0131 olaca\u011f\u0131ndan bu hususa mutlaka dikkat edilmelidir.<\/p>\n\n\n\n<p><strong>3. Kirac\u0131n\u0131n Temerr\u00fcde D\u00fc\u015fme S\u00fcresi<\/strong><\/p>\n\n\n\n<p>Yine TBK ifadesiyle kirac\u0131n\u0131n kira bedelini veya yan gideri \u00f6dememesi durumunda <em>\u201ckiraya veren kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verip, bu s\u00fcrede de ifa etmeme durumunda, s<\/em><em>\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir. Kirac\u0131ya verilecek s\u00fcre en az on g\u00fcn, konut ve <\/em><em>\u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise <strong>en az otuz g\u00fcnd\u00fcr.<\/strong> Bu s\u00fcre, kirac\u0131ya yaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 tarihi izleyen g\u00fcnden itibaren i\u015flemeye ba\u015flar.\u201d<\/em>&nbsp; <strong><em><u>(TBK m. 315)<\/u><\/em><\/strong><\/p>\n\n\n\n<p><br>Her ne kadar kanun lafz\u0131nda \u201cyaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 g\u00fcn\u201d denmekte ise de esasen bu s\u00fcreler bildirimin kirac\u0131n\u0131n eline ula\u015fmas\u0131yla ba\u015flar ve kirac\u0131 edimini ifa etmezse s\u00f6zle\u015fme dava yoluyla <em>(Bkz: Kirac\u0131n\u0131n Temerr\u00fcd\u00fc Nedeniyle S\u00f6zle\u015fmenin Feshi Ve Tahliye Davas\u0131 Ba\u015fl\u0131kl\u0131 Yaz\u0131m\u0131z) <\/em>sona erdirilebilir.<\/p>\n\n\n\n<p><strong>4. Kira S\u00f6zle\u015fmesinin Devri Durumunda Kirac\u0131lar\u0131n Sorumlulu\u011fu<\/strong><\/p>\n\n\n\n<p>Kural olarak kiraya verenin r\u0131zas\u0131 olmad\u0131k\u00e7a kirac\u0131, kira s\u00f6zle\u015fmesini devredemez. R\u0131za akabinde kirac\u0131n\u0131n kira s\u00f6zle\u015fmesini kendi a\u00e7\u0131s\u0131ndan devretmesi halinde (\u00f6rne\u011fin i\u015fyeri devri gibi) bu durumda devreden kirac\u0131, devralan yeni kirac\u0131 ile beraber kira s\u00f6zle\u015fmesinin sonuna kadar fakat en fazla iki y\u0131l s\u00fcreyle sorumlu olur. Yani kira s\u00f6zle\u015fmesinin sona ermesine 5 y\u0131l var iken kirac\u0131 kira s\u00f6zle\u015fmesini devrederse bu s\u00fcre boyunca de\u011fil aksi kararla\u015ft\u0131r\u0131lmad\u0131\u011f\u0131 m\u00fcddet\u00e7e en fazla 2 y\u0131l boyunca devralanla birlikte m\u00fcteselsil sorumlu olur. <strong><em><u>(TBK m.323)<\/u><\/em><\/strong><\/p>\n\n\n\n<p><strong>5. Kirac\u0131n\u0131n S\u00f6zle\u015fme S\u00fcresine Uymaks\u0131z\u0131n Kiralanan\u0131 Tahliyesi<\/strong><\/p>\n\n\n\n<p>Bu durum da Kanun\u2019da d\u00fczenlenmi\u015f olup kirac\u0131 e\u011fer s\u00f6zle\u015fme s\u00fcresini beklemeden akdi fesheder ve\/veya kiralanan\u0131 tahliye ve teslim ederse bu durumda kiralanan\u0131n yeniden kiralanabilmesi i\u00e7in yeterli olacak makul bir s\u00fcre i\u00e7in kira bedelinden sorumlu olur. <strong><em><u>(TBK m. 325)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Bu s\u00fcre konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131 i\u00e7in yerle\u015fik Yarg\u0131tay uygulamalar\u0131 \u00e7er\u00e7evesinde b\u00fcy\u00fck\u015fehirler i\u00e7in 2 ay civar\u0131, ta\u015fra b\u00f6lgeler i\u00e7in ise 3 ay civar\u0131ndad\u0131r.<\/p>\n\n\n\n<p><strong>6. Belirsiz S\u00fcreli Kira S\u00f6zle\u015fmelerinde Fesih S\u00fcresi<\/strong><\/p>\n\n\n\n<p>Ta\u015f\u0131n\u0131r kiralar\u0131 i\u00e7in Kanun\u2019daki genel fesih bildirim s\u00fcreleri ge\u00e7erlidir. Ta\u015f\u0131nmaz ve ta\u015f\u0131n\u0131r yap\u0131 kiralar\u0131 i\u00e7inse alt\u0131 aydan uzun s\u00fcreli kira s\u00f6zle\u015fmelerine ili\u015fkin \u00f6zel durum a\u015fa\u011f\u0131da a\u00e7\u0131klanm\u0131\u015ft\u0131r <em>(Bkz: 12 madde).<\/em>&nbsp; 6 ay veya daha k\u0131sa s\u00fcreli ta\u015f\u0131nmaz ve ta\u015f\u0131n\u0131r yap\u0131lar i\u00e7inse 6 ayl\u0131k kira d\u00f6neminin sonu i\u00e7in 3 ayl\u0131k fesih bildirim s\u00fcrelerine uyularak fesih ger\u00e7ekle\u015ftirilebilir. <strong><em><u>(TBK m. 329)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>\u00d6rne\u011fin 10 May\u0131s 2024\u2019ten 10 Kas\u0131m 2024\u2019e kadar akdedilmi\u015f bir ta\u015f\u0131nmaz kira s\u00f6zle\u015fmesi bin feshinde (mevsimlik veya sezonluk kiralama d\u00fc\u015f\u00fcn\u00fclebilir) 10 A\u011fustos 2024 tarihinde fesih bildiriminde bulunulmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>7. Ta\u015f\u0131n\u0131r Kiralar\u0131nda Fesih S\u00fcresi<\/strong><\/p>\n\n\n\n<p>Ta\u015f\u0131n\u0131r kiralar\u0131nda taraflardan her biri kira s\u00f6zle\u015fmesini \u00fc\u00e7 g\u00fcn \u00f6nceden yapaca\u011f\u0131 bildirimle her zaman feshedebilir.&nbsp; <strong><em><u>(TBK M. 330).<\/u><\/em><\/strong><\/p>\n\n\n\n<p><strong>8. Tahliye Akabinde Kiralanan\u0131n G\u00f6zden Ge\u00e7irilmesi Ve Kirac\u0131ya Bildirim<\/strong><\/p>\n\n\n\n<p>Kural olarak kiralayan, kiralanan\u0131n durumunu kirac\u0131dan teslim al\u0131rken derhal kontrol edip kendisine ay\u0131p ve eksikleri bildirmek zorundad\u0131r. (<strong><em><u>TBK m. 335)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>&nbsp;Tahliye kiralanan\u0131n yoklu\u011funda yap\u0131lm\u0131\u015fsa ki \u00f6rne\u011fin anahtar notere tevdi edilmi\u015fse, bu durumda kiralayan, anahtar\u0131 teslim al\u0131r almaz kirac\u0131ya bildirimde bulunmal\u0131d\u0131r. Buradaki uygulama, kiralanan\u0131n bo\u015falt\u0131lmas\u0131nan 2 aydan fazla bir s\u00fcre ge\u00e7tikten sonra ay\u0131p ihbar\u0131 yap\u0131lmas\u0131 durumunda \u201cderhal bildirim \u015fart\u0131na uyulmad\u0131\u011f\u0131\u201d gerek\u00e7esiyle zarar ve ziyan taleplerinin reddi \u015feklinde olabilmektedir. Bu sebeple zarar ve ziyan durumunda kiralanan\u0131n durumu kiraya veren taraf\u0131ndan belgelendirilmeli, kirac\u0131ya vakit kaybedilmeksizin noter kanal\u0131yla ihtar g\u00f6nderilmelidir.<\/p>\n\n\n\n<p><strong>9. Kira Bedelinin Artt\u0131r\u0131lma S\u00fcresi <u>(Kira Tespit Davas\u0131nda S\u00fcreler)<\/u><\/strong><\/p>\n\n\n\n<p>Kanun lafz\u0131yla ifade etmek gerekirse: \u201c<em>Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir. Her be\u015f y\u0131ldan sonraki kira y\u0131l\u0131nda bu bi\u00e7imde belirlenen kira bedeli, \u00f6nceki f\u0131kralarda yer alan ilkelere g\u00f6re de\u011fi\u015ftirilebilir<\/em>\u201d. <strong><em><u>(TBK m. 344)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>&nbsp;Anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere ister 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi uzayarak 5. Y\u0131l\u0131n\u0131 bitirmi\u015f olsun, ister s\u00f6zle\u015fme 5 y\u0131ldan uzun olsun 5. Y\u0131l\u0131 izleyen kira d\u00f6nemi i\u00e7in kira bedelinin rayi\u00e7lere ve hakkaniyete g\u00f6re tespiti istenebilir. Burada genel uygulama, daval\u0131 kirac\u0131, \u201ceski kirac\u0131\u201d say\u0131ld\u0131\u011f\u0131 i\u00e7in hakkaniyet gere\u011fi rayi\u00e7lerin %10\u2019u ile %15\u2019i aras\u0131nda bir indirim yap\u0131lmas\u0131 suretiyle kira bedelinin uyarlanmas\u0131 \u015feklinde olmaktad\u0131r <em>(Bkz: Kira Tespit ve Uyarlama Davalar\u0131 Ba\u015fl\u0131kl\u0131 Yaz\u0131m\u0131z).<\/em><\/p>\n\n\n\n<p>5. Y\u0131l\u0131n sonunda veya 5 y\u0131l\u0131n\u0131 doldurmu\u015f kira s\u00f6zle\u015fmelerinde hangi y\u0131l i\u00e7in kira bedelinin tespiti istenecekse tespit edilecek yeni bedelin talep edilen kira y\u0131l\u0131nda ge\u00e7erli hale gelmesi i\u00e7in kira bedelinin tespiti davas\u0131n\u0131n yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 30 g\u00fcn \u00f6ncesinde a\u00e7\u0131lmas\u0131 veya en ge\u00e7 bu s\u00fcrede kirac\u0131ya kira bedelinin artt\u0131r\u0131laca\u011f\u0131na ili\u015fkin yaz\u0131l\u0131 bildirimde bulunulmas\u0131 gerekmektedir. <strong><em><u>(TBK m. 345)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>\u00d6rne\u011fin; 10 May\u0131s 2019 tarihinde imzalanm\u0131\u015f bir kira s\u00f6zle\u015fmesinin 5. Y\u0131l\u0131 10 May\u0131s 2024 tarihinde dolmakta oldu\u011fundan, e\u011fer 10 May\u0131s 2024 itibariyle ba\u015flayacak 6. Kira y\u0131l\u0131 i\u00e7in kira bedelinin tespiti talep edilecekse bu davan\u0131n en ge\u00e7 10 Nisan 2024 tarihinde a\u00e7\u0131lm\u0131\u015f olmas\u0131 veya en ge\u00e7 10 Nisan 2024\u2019e kadar kirac\u0131ya kira bedelinin artt\u0131r\u0131laca\u011f\u0131na dair yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 gerekir.<\/p>\n\n\n\n<p>Belirtmek gerekir ki 5. Y\u0131l\u0131 izleyen d\u00f6nem i\u00e7in yani yukar\u0131daki \u00f6rnekte 10 May\u0131s 2024 tarihinde ba\u015flayacak 6. Kira y\u0131l\u0131 i\u00e7in hen\u00fcz 6. Y\u0131l ba\u015flamadan da dava a\u00e7\u0131labilir. Talep tarihi olarak 10 May\u0131s 2024\u2019te ba\u015flayan 6. Kira y\u0131l\u0131ndaki kira bedelinin tespitinin talep edilmesi yeterli olup bu dava 5. Kira y\u0131l\u0131 i\u00e7erisinde ikame edilebilir.<\/p>\n\n\n\n<p><strong>10. Konut ve \u00c7at\u0131l\u0131 \u0130\u015fyeri Kiralar\u0131nda Kirac\u0131n\u0131n S\u00f6zle\u015fmeyi Sona Erdirme S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kural olarak kirac\u0131, s\u00f6zle\u015fme bitiminden en az 15 g\u00fcn \u00f6nce bildirimde bulunmad\u0131\u011f\u0131 m\u00fcddet\u00e7e kira s\u00f6zle\u015fmesi uzar. <strong><em><u>(TBK m. 347)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n kira s\u00f6zle\u015fmesini feshetmeyi istemesi halinde s\u00f6zle\u015fme bitiminden en ge\u00e7 15 g\u00fcn \u00f6ncesinde fesih bildiriminde bulunmas\u0131 gereklidir. Kiraya veren, a\u015fa\u011f\u0131da a\u00e7\u0131klanacak 10 y\u0131ll\u0131k uzama s\u00fcresinin bitimi haricinde bildirimde bulunarak s\u00f6zle\u015fmeyi feshedemez.<strong><em><u> (TBK m. 347)<\/u><\/em><\/strong><\/p>\n\n\n\n<p><strong>11. Kiraya Veren Taraf\u0131ndan S\u00f6zle\u015fme S\u00fcresinin Bitmesi Nedeniyle Fesih S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n aksine kiraya verenin s\u00f6zle\u015fmeyi s\u00f6zle\u015fme s\u00fcresinin sonunda&nbsp; fesih bildirimiyle sona erdirme imkan\u0131 kural olarak yoktur. Ancak TBK\u2019nin 347. Maddesi \u00e7er\u00e7evesinde Kanun ifadesiyle ; <em>\u201cKiraya veren, s<\/em><em>\u00f6<\/em><em>zle\u015fme s\u00fcresinin bitimine dayanarak s<\/em><em>\u00f6<\/em><em>zle\u015fmeyi sona erdiremez. Ancak, on y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 <\/em><em>ay <\/em><em>\u00f6<\/em><em>nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g<\/em><em>\u00f6<\/em><em>stermeksizin s<\/em><em>\u00f6<\/em><em>zle\u015fmeye son verebilir.\u201d<\/em> <strong><em><u>(TBK m. 347)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>\u00d6rne\u011fin 10 May\u0131s 2024 tarihinde imzalanm\u0131\u015f 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmesinin biti\u015fi 10 May\u0131s 2025, 10 y\u0131ll\u0131k uzama s\u00fcresinin bitimi 10 May\u0131s 2035 oldu\u011fundan ve kiraya veren bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden yani 10 May\u0131s 2035\u2019i izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az 3 ay \u00f6nce g\u00f6nderece\u011fi fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilece\u011finden; 10 May\u0131s 2036\u2019dan en az 3 ay \u00f6nce yani 10 \u015eubat 2036\u2019dan \u00f6nce kirac\u0131n\u0131n eline ula\u015ft\u0131r\u0131lacak fesih bildirimiyle kira s\u00f6zle\u015fmesini feshedilebilir.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin bir y\u0131ll\u0131k de\u011fil de 5 veya 10 y\u0131ll\u0131k yap\u0131lmas\u0131 gibi durumlarda uzama s\u00fcresi, s\u00f6zle\u015fme s\u00fcresinin bitiminden itibaren ba\u015flar. Yani bu durumda s\u00f6zle\u015fme s\u00fcresine ek 10 y\u0131l ve izleyen uzama y\u0131l\u0131 beklenmek zorunda oldu\u011fundan; \u201cs\u00f6zle\u015fme s\u00fcresi (bir, be\u015f, on y\u0131l veya s\u00fcresi ne ise o kadarl\u0131k bir zaman dilimi) + 10 y\u0131ll\u0131k uzama s\u00fcresi + izleyen uzama y\u0131l\u0131 (bu y\u0131l\u0131n bitimine 3 ay kala ihtarname g\u00f6nderilmelidir)\u201d \u015feklinde \u00f6zetlenebilecek bir s\u00fcre\u00e7 izlenecektir.<\/p>\n\n\n\n<p>Fesih bildirimleri muhakkak yaz\u0131l\u0131 \u015fekilde, ispat a\u00e7\u0131s\u0131ndan sorun ya\u015famamak ad\u0131na noterden yap\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>12. Belirsiz S\u00fcreli Konut ve \u00c7at\u0131l\u0131 \u0130\u015fyeri Kiralar\u0131nda 10 Y\u0131ll\u0131k S\u00fcre<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Bu durumda da Kiralayan\u0131n fesih hakk\u0131 mevcut olup Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman, kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilirler. <strong><em><u>(TBK m. 347)<\/u><\/em><\/strong><strong><em><u><\/u><\/em><\/strong><\/p>\n\n\n\n<p>&nbsp;Burada kanun lafz\u0131nda uzama y\u0131l\u0131 gibi bir ibare ge\u00e7medi\u011fi i\u00e7in fesih bildirim s\u00fcrelerine uyularak kira ba\u015flang\u0131c\u0131ndan 10 y\u0131l sonra, kan\u0131m\u0131zca 11. Y\u0131lda fesih bildirimiyle belirsiz s\u00fcreli kira s\u00f6zle\u015fmesi sona erdirilebilir.<\/p>\n\n\n\n<p><strong>13.&nbsp; Kiraya Verenden Kaynakl\u0131 Sebeplerle (\u0130htiya\u00e7, Yeniden \u0130n\u015fa ve \u0130mar) Tahliye Durumunda Dava A\u00e7ma S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Bu durumda kira s\u00f6zle\u015fmesinin bitiminden itibaren en ge\u00e7 bir ay i\u00e7inde dava a\u00e7\u0131lmal\u0131d\u0131r. Aksi takdirde dava s\u00fcre y\u00f6n\u00fcnden reddedilir. S\u00fcreler kamu d\u00fczeninden oldu\u011fundan hakim bu hususu re\u2019 sen (kendili\u011finden) dikkate al\u0131r. <strong><em>(TBK m. 350)<\/em><\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin bitimi, s\u00f6zle\u015fmenin kirac\u0131 taraf\u0131ndan feshedilmemesi nedeniyle her y\u0131l uzamas\u0131 halinde her y\u0131l i\u00e7in uzama g\u00fcn\u00fcn\u00fc takip eden g\u00fcnden itibaren 1 ay olarak kabul edilir.<\/p>\n\n\n\n<p>\u00d6rne\u011fin 10 May\u0131s 2019 tarihli bir s\u00f6zle\u015fme kirac\u0131 taraf\u0131ndan feshedilmemi\u015fse kiralayan, her y\u0131l 10 May\u0131s tarihinden itibaren 1 ay i\u00e7inde davas\u0131n\u0131 a\u00e7mal\u0131d\u0131r. A\u015fa\u011f\u0131da a\u00e7\u0131klanacak dava a\u00e7ma s\u00fcresinin uzamas\u0131 hali ayr\u0131ca de\u011ferlendirilir.<\/p>\n\n\n\n<p><strong>14. Dava A\u00e7ma S\u00fcresinin Uzamas\u0131<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kiraya verenden kaynakl\u0131 sebeplerle a\u00e7\u0131lacak dava s\u00fcresi, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6n g\u00f6r\u00fclen s\u00fcrede yani uzama d\u00f6neminden itibaren bir ayl\u0131k s\u00fcre i\u00e7inde kirac\u0131ya dava a\u00e7\u0131laca\u011f\u0131na dair yaz\u0131l\u0131 bildirimde bulunulmas\u0131 halinde bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r. <strong><em><u>(TBK m. 353)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>\u00d6rne\u011fin 10 May\u0131s 2019 tarihli uzam\u0131\u015f bir kira s\u00f6zle\u015fmesi i\u00e7in kirac\u0131ya tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131na ili\u015fkin yaz\u0131l\u0131 bildirim 20 May\u0131s 2024 tarihinde yap\u0131l\u0131rsa; 10 May\u0131s 2025 tarihine kadar yani bildirimin yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n sonuna kadar ikame edilebilecektir.<\/p>\n\n\n\n<p><strong>15. Yeni Malikin Gereksinimi Nedeniyle Tahliye Davas\u0131 S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Bu durumda <em>\u201cyeni malik kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011f<\/em><em>u di<\/em><em>\u011fer ki\u015filer i<\/em><em>\u00e7<\/em><em>in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i<\/em><em>\u00e7<\/em><em>inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s<\/em><em>\u00f6<\/em><em>zle\u015fmesini alt\u0131 ay sonra a<\/em><em>\u00e7<\/em><em>aca\u011f\u0131 bir davayla sona erdirebilir.\u201d <strong><u>(TBK m. 351)<\/u><\/strong><\/em><\/p>\n\n\n\n<p>Buradaki bir ayl\u0131k s\u00fcre a\u00e7\u0131s\u0131ndan dikkat edilmesi gereken husus; bildirimin bu s\u00fcre i\u00e7erisinde kirac\u0131n\u0131n eline ge\u00e7me zorunlulu\u011fudur. Salt bu s\u00fcre i\u00e7erisinde ihtar g\u00f6nderilmi\u015f olmas\u0131 dava hakk\u0131 do\u011furmaz, edinme tarihinden itibaren 1 ay i\u00e7inde ihtar\u0131n muhakkak kirac\u0131n\u0131n eline ge\u00e7mi\u015f olmas\u0131 da gerekir, aksi takdirde yeni malikin ihtiyac\u0131 sebebiyle dava a\u00e7ma hakk\u0131 s\u00fcre nedeniyle d\u00fc\u015fer.<\/p>\n\n\n\n<p>6 ayl\u0131k s\u00fcre iktisap tarihinden ba\u015flar. Bu s\u00fcrenin beklenmesi zorunludur. 6 ayl\u0131k s\u00fcre ge\u00e7tikten sonra derhal tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131na dair bir d\u00fczenleme bulunmamakla, kanaatimizce \u00e7ok uzun bir s\u00fcre ge\u00e7meden, 6 ayl\u0131k s\u00fcrenin ge\u00e7mesinden de en fazla birka\u00e7 ay i\u00e7erisinde veya yeni kira y\u0131l\u0131 ba\u015flayana kadar bu s\u00fcrede dava a\u00e7\u0131lmas\u0131 uygulamada olumsuz kararlar\u0131n \u00f6n\u00fcne ge\u00e7ecektir.<\/p>\n\n\n\n<p><strong>16. Yeni Malikin S\u00f6zle\u015fmenin Taraf\u0131 Olmas\u0131 Nedeniyle Tahliye Davas\u0131 A\u00e7ma S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>TBK gere\u011fi yeni malik s\u00f6zle\u015fmenin taraf\u0131 oldu\u011fundan, ihtiya\u00e7 iddias\u0131 ile <strong><em><u>(TBK m. 310)<\/u><\/em><\/strong> bir ay i\u00e7inde g\u00f6nderece\u011fi ihtarnameyle 6 ay sonunda tahliye davas\u0131 a\u00e7abilece\u011fi gibi, s\u00f6zle\u015fme bitiminden (veya i\u00e7inde bulunulan uzama y\u0131l\u0131n\u0131n bitiminden) itibaren 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde de dava a\u00e7abilir.&nbsp; \u015eu kadar ki \u00f6ncesinde yeni malik kirac\u0131ya 6 ayl\u0131k s\u00fcreyi vermi\u015f ise bu s\u00fcreyi beklemek zorundad\u0131r. Bu sebeple e\u011fer s\u00f6zle\u015fmenin veya ilgili uzama y\u0131l\u0131n\u0131n bitimine 6 aydan k\u0131sa bir s\u00fcre varsa kirac\u0131ya 6 ay s\u00fcre verildi\u011fine dair ihtarname g\u00f6ndermek yerine \u201cs\u00f6zle\u015fme s\u00fcresinin bitiminde tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131na dair\u201d genel ihtiya\u00e7 sebebine dayal\u0131 bir ihtarname g\u00f6nderilmesi daha yerinde olacakt\u0131r.<\/p>\n\n\n\n<p><strong>17. Tahliye Taahh\u00fcd\u00fc Verilmesi Durumunda Dava A\u00e7ma S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir.<strong><em><u> (TBK m. 352)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Tahliye taahh\u00fcd\u00fc verilmesi durumunda tahliye tarihinden (taahh\u00fct edilen tarihten) itibaren bir ay i\u00e7inde ya tahliye talepli icra takibi ya da dava a\u00e7\u0131lmal\u0131d\u0131r. Aksi takdirde hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre nedeniyle tahliye taahh\u00fcd\u00fcne dayal\u0131 olarak kirac\u0131n\u0131n tahliyesi istenemez.<\/p>\n\n\n\n<p><strong>18. Kira Bedelinin \u00d6denmemesi Sebebiyle Kirac\u0131ya \u0130htar G\u00f6nderilmesi Akabinde Tahliye Davas\u0131 S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p><em>\u201cKirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir.\u201d<\/em> <strong><em><u>(TBK m. 352\/2)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesi 1 y\u0131ldan k\u0131sa s\u00fcreli ise bu kira y\u0131l\u0131nda, bir y\u0131l veya daha uzun s\u00fcreli ise veyahut s\u00f6zle\u015fme kirac\u0131 taraf\u0131ndan feshedilmedi\u011fi i\u00e7in uzam\u0131\u015f ise ilgili kira y\u0131l\u0131nda kirac\u0131 kira bedelini \u00f6demez ve kiraya veren de bu sebeple kirac\u0131ya ihtarname g\u00f6nderir veyahut kira bedelinin \u00f6denmesine ili\u015fkin icra takibi a\u00e7arsa, \u00f6demenin ihtarnamenin veya icra takibi a\u00e7\u0131lmas\u0131 durumunda \u00f6deme emrinin kirac\u0131ya ula\u015fmas\u0131 akabinde yap\u0131lmas\u0131 \u015fart\u0131yla ayn\u0131 kira y\u0131l\u0131nda iki hakl\u0131 bildirim akabinde <em>-icra takibi de bildirim say\u0131l\u0131r-<\/em> kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n\n\n\n<p>Burada \u00f6nem arz eden husus \u201ckira y\u0131l\u0131\u201d hususudur. Yine ayn\u0131 \u00f6rnekle; 10 May\u0131s 2024 tarihli bir&nbsp; kira s\u00f6zle\u015fmesi i\u00e7in, s\u00f6zle\u015fme s\u00fcresi bir y\u0131l ise 10 May\u0131s 2025\u2019e kadar 2 kere kendisine hakl\u0131 olarak ihtar g\u00f6nderilmesine (veya icra takibi a\u00e7\u0131lmas\u0131na) sebep olursa, 10 May\u0131s 2025\u2019ten itibaren bir ay i\u00e7inde kirac\u0131ya bu sebeple tahliye davas\u0131 a\u00e7\u0131labilir. Belirtmek gerekir ki burada ihtar\u0131n hangi ay g\u00f6nderildi\u011fi dava s\u00fcresi a\u00e7\u0131s\u0131ndan \u00f6nemli de\u011fildir. Haziran ve Temmuz 2024 d\u00f6nemlerinde iki hakl\u0131 ihtar g\u00f6nderilse dahi May\u0131s 2025 beklenmeli ve bu s\u00fcreden itibaren bir ay i\u00e7inde dava a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Bir di\u011fer husus da \u015fudur ki Kanun a\u00e7\u0131k\u00e7a kira y\u0131l\u0131ndan bahsetmekte oldu\u011fundan \u00f6rne\u011fin kira s\u00f6zle\u015fmesi 5 y\u0131ll\u0131k dahi olsa bir kira y\u0131l\u0131 i\u00e7erisinde (12 ayl\u0131k s\u00fcre\u00e7te) iki hakl\u0131 ihtar (veya icra takibi) \u015fart\u0131 sa\u011flanm\u0131\u015fsa, bu kira y\u0131l\u0131n\u0131n bitiminden itibaren bir ay i\u00e7inde bu sebeple dava a\u00e7\u0131labilecektir. Bu durumda 5 y\u0131ll\u0131k s\u00f6zle\u015fme s\u00fcresinin bitiminin beklenmesine gerek yoktur.<\/p>\n\n\n\n<p>Kanun\u2019da d\u00fczenlenmese de kira bedelinin y\u0131ll\u0131k \u00f6dendi\u011fi durumda da e\u011fer \u00f6deme geciktirilmi\u015fse kan\u0131m\u0131zca aralar\u0131nda en az 1 ay olmak \u015fart\u0131yla \u00f6deme talebiyle g\u00f6nderilecek iki ihtarname ile yine kira y\u0131l\u0131 sonunda tahliye davas\u0131 a\u00e7ma hakk\u0131 kazan\u0131labilecektir. Bu durumda daha pratik bir yol olarak&nbsp; tahliye talepli icra takibine giri\u015filip takipte verilecek 30 g\u00fcnl\u00fck \u00f6deme s\u00fcresi i\u00e7erisinde y\u0131ll\u0131k kira bedelinin \u00f6denmemesi durumunda temerr\u00fct nedeniyle tahliye yoluna gidilmesi daha makul bir \u00e7\u00f6z\u00fcm olabilir.<\/p>\n\n\n\n<p><strong>19. Kirac\u0131n\u0131n veya E\u015finin Ayn\u0131 \u0130l\u00e7e veya Belediye S\u0131n\u0131rlar\u0131nda Konutunun Oldu\u011funun \u00d6\u011frenilmesi Halinde Tahliye Davas\u0131 A\u00e7ma S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin ayn\u0131 il\u00e7e veya belde belediye s\u0131n\u0131rlar\u0131 i\u00e7inde oturmaya elveri\u015fli bir konutu bulunmas\u0131 durumunda kiraya veren, kira s\u00f6zle\u015fmesinin kurulmas\u0131 s\u0131ras\u0131nda bunu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden ba\u015flayarak bir ay i\u00e7inde s\u00f6zle\u015fmeyi dava yoluyla sona erdirebilir. <strong><em><u>(TBK m. 352\/3)<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Her ne kadar Kanun lafz\u0131ndan yorum yoluyla \u00e7\u0131kart\u0131lmas\u0131 m\u00fcmk\u00fcn bir sonu\u00e7 olsa da burada bir ayl\u0131k s\u00fcre, kirac\u0131n\u0131n veya e\u015finin an\u0131lan \u015fekilde bir konutunun varl\u0131\u011f\u0131n\u0131n \u00f6\u011frenildi\u011fi kira y\u0131l\u0131n\u0131n sonundan itibaren ba\u015flamaktad\u0131r.<\/p>\n\n\n\n<p>H\u00fck\u00fcm k\u0131yasen uzama y\u0131llar\u0131 i\u00e7in de uygulanabilir durumdad\u0131r. \u00d6rne\u011fin 10 May\u0131s 2019\u2019da akdedilmi\u015f bir kira s\u00f6zle\u015fmesi s\u00f6z konusu ise ve s\u00f6zle\u015fme kurulurken kirac\u0131n\u0131n veya e\u015finin an\u0131lan \u015fekilde bir konutunun bulundu\u011fu 10 \u015eubat 2024 tarihinde \u00f6\u011frenilirse yine 10 May\u0131s 2024\u2019ten itibaren yani ilgili uzama y\u0131l\u0131n\u0131n bitiminden itibaren bir ay i\u00e7inde bu sebebe dayanarak tahliye davas\u0131 a\u00e7abilecektir.<\/p>\n\n\n\n<p><strong>17. Yeniden Kiralama Yasa\u011f\u0131 S\u00fcresi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Kiralayan,&nbsp; gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz. Yeniden in\u015fa ve imar amac\u0131yla bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar, eski h\u00e2li ile, hakl\u0131 sebep olmaks\u0131z\u0131n \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e ba\u015fkas\u0131na kiralanamaz. Eski kirac\u0131n\u0131n, yeniden in\u015fa ve imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazlar\u0131, yeni durumu ve yeni kira bedeli ile kiralama konusunda \u00f6ncelik hakk\u0131 vard\u0131r. Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimi izleyen bir ay i\u00e7inde kullan\u0131lmas\u0131 gerekir; bu \u00f6ncelik hakk\u0131 sona erdirilmedik\u00e7e, ta\u015f\u0131nmaz \u00fc\u00e7 y\u0131l ge\u00e7meden ba\u015fkas\u0131na kiralanamaz. Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.
