Ancak bu iki farkl\u0131 dava t\u00fcr\u00fc s\u0131k s\u0131k kar\u0131\u015ft\u0131r\u0131lmaktad\u0131r. A\u015fa\u011f\u0131daki yaz\u0131m\u0131zda bu dava t\u00fcrlerine ve farkl\u0131l\u0131klar\u0131na k\u0131saca de\u011finece\u011fiz.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin en \u00f6nemli \u00f6gelerinden biri kira bedelidir. Bor\u00e7lar hukukuna g\u00f6re kira s\u00f6zle\u015fmesi kurulurken, taraflar kira bedelini serbest\u00e7e belirleyebilirler. Ancak kira bedelinin yenileme d\u00f6nemlerinde kira bedelinin belirlenmesi birtak\u0131m k\u0131s\u0131tlamalara tabidir.<\/p>\n\n\n\n<p><strong>Kira Tespit Davas\u0131<\/strong><\/p>\n\n\n\n<p>Kira tespit davas\u0131 kirac\u0131 veya kiraya veren taraf\u0131ndan gerekli \u015fartlar\u0131n varl\u0131\u011f\u0131 ile a\u00e7\u0131labilmektedir. Ancak kira s\u00f6zle\u015fmesinde birden \u00e7ok kiraya veren bulunuyorsa, bu ki\u015filer mecburi dava arkada\u015f\u0131 olarak kabul edildi\u011fi i\u00e7in davay\u0131 birlikte a\u00e7mak zorundad\u0131rlar.<\/p>\n\n\n\n<p>Bir sonraki kira d\u00f6nemi i\u00e7in art\u0131\u015f oran\u0131 belirlenmemi\u015f ise veya kira s\u00f6zle\u015fmesi be\u015f y\u0131l\u0131n\u0131 doldurmu\u015f ancak kira bedeli emsal kiralara g\u00f6re d\u00fc\u015f\u00fck bir bedelde kalm\u0131\u015f ise kira tespit davas\u0131 a\u00e7\u0131labilmektedir. Burada dikkat edilecek husus hukuki menfaatin bulunup bulunmamas\u0131d\u0131r. Kan\u0131m\u0131zca s\u00f6zle\u015fmede art\u0131\u015f maddesi yoksa veya her y\u0131l i\u00e7in ge\u00e7erli kabul edilmemi\u015fse ve bunlara ek olarak s\u00f6zle\u015fme be\u015f y\u0131l\u0131n\u0131 doldurmu\u015fsa kira tespit talebinde bulunmak i\u00e7in hukuki menfaatin varl\u0131\u011f\u0131 kabul edilebilecektir.<\/p>\n\n\n\n<p>Devamla; T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344. maddesine g\u00f6re;<\/p>\n\n\n\n<p>\u2018<strong>\u2019<\/strong><strong>Taraflar aras\u0131nda yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131 var ise<\/strong>, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erli kabul edilmektedir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r.\u2019\u2019<\/p>\n\n\n\n<p>\u2018<strong>\u2019Taraflar aras\u0131nda bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa,<\/strong> kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir.\u2019\u2019<\/p>\n\n\n\n<p>\u2018<strong>\u2019Be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde<\/strong>, taraflar aras\u0131nda bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n dava a\u00e7\u0131labilir. Yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenmektedir. Her be\u015f y\u0131lda bir bu bi\u00e7imde belirlenen kira bedeli, \u00f6nceki f\u0131kralarda yer alan ilkelere g\u00f6re de\u011fi\u015ftirilebilir.\u2019\u2019<\/p>\n\n\n\n<p>Uygulamada be\u015f y\u0131l\u0131 dolmu\u015f kira s\u00f6zle\u015fmeleri i\u00e7in; g\u00fcncel emsallere g\u00f6re %10 ile %15 aras\u0131nda bir hakkaniyet indirimi yap\u0131larak, hak ve nesafet uygun yeni kira bedeli tespit edilmektedir.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi, 22.09.2022 tarihli 2022\/5205 E. ve 2022\/6879 K. say\u0131l\u0131 karar\u0131nda <\/strong><em>\u2018\u2019Hak ve nesafet uygun kira belirlenirken; en son \u00f6denen ayl\u0131k kira bedeline endekse (\u00dcFE) g\u00f6re art\u0131\u015f yap\u0131larak belirlenen kiradan daha d\u00fc\u015f\u00fck olmayacak \u015fekilde ta\u015f\u0131nmaz\u0131n bo\u015f olarak yeniden kiraya verilmesi halinde getirebilece\u011fi kira bedelinden, daval\u0131n\u0131n eski kirac\u0131 oldu\u011fu g\u00f6zetilerek hakkaniyete uygun bir miktarda indirim yap\u0131lmas\u0131 gerekmektedir.\u2019\u2019<\/em> \u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinde art\u0131\u015f maddesi bulunmuyor ise her y\u0131l i\u00e7in mahkemeden kira bedelinin tespitini talep etmek m\u00fcmk\u00fcnd\u00fcr. Bu durumda mahkeme, emsalleri de nazara alacak ancak azami olarak 12 ayl\u0131k T\u00dcFE ortalamas\u0131nca bir art\u0131\u015f yap\u0131larak izleyen y\u0131l i\u00e7in kira bedelini belirleyecektir. 5 y\u0131l dolduktan sonra a\u00e7\u0131lan tespit davalar\u0131 i\u00e7in bu kural ge\u00e7erli olmay\u0131p yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z \u00fczere h\u00e2kim rayi\u00e7 kira bedellerine g\u00f6re, %10-15 aras\u0131nda bir hakkaniyet indirimi yapmak suretiyle bir bedele h\u00fckmedecektir.<\/p>\n\n\n\n<p><strong>Dava A\u00e7ma S\u00fcresi<\/strong><\/p>\n\n\n\n<p>Kira bedelinin belirlenmesine ili\u015fkin dava her zaman a\u00e7\u0131labilmektedir.<\/p>\n\n\n\n<p>Ancak dava, yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131lm\u0131\u015f olmas\u0131 veya kiraya veren taraf\u0131ndan yine bu s\u00fcre i\u00e7erisinde, kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunmu\u015f olmas\u0131 ko\u015fuluyla, bir sonraki kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar.<\/p>\n\n\n\n<p>S\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa, yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de, bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur.<\/p>\n\n\n\n<p><strong>Yetkili ve G\u00f6revli Mahkeme<\/strong><\/p>\n\n\n\n<p>Kira tespit davas\u0131nda g\u00f6revli ve yetkili mahkeme, s\u00f6zle\u015fmenin ifa yerindeki veya daval\u0131n\u0131n yerle\u015fim yerinde <strong>Sulh Hukuk Mahkemesidir<\/strong>.<\/p>\n\n\n\n<p><strong>Zorunlu Arabuluculuk<\/strong><\/p>\n\n\n\n<p>01.09.2023 tarihinden itibaren a\u00e7\u0131lacak kira tespit davalar\u0131nda dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurmak dava \u015fart\u0131 haline gelmi\u015ftir. Bu nedenle arabulucuya ba\u015fvurulmadan do\u011frudan a\u00e7\u0131lan davalar usul eksikli\u011fi sebebiyle reddedilmektedir.<\/p>\n\n\n\n<p><strong>Kira Uyarlama Davas\u0131 (T\u00fcrk Bor\u00e7lar Kanunu m. 138)<\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 s\u0131rada mevcut olmayan ola\u011fan\u00fcst\u00fc hal ve \u015fartlar\u0131n daha sonras\u0131nda ortaya \u00e7\u0131kmas\u0131 sebebiyle s\u00f6zle\u015fmede ifa g\u00fc\u00e7l\u00fc\u011f\u00fc olu\u015fabilmektedir. Bu ola\u011fan\u00fcst\u00fc hal ve \u015fartlar s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada \u00f6ng\u00f6r\u00fclemez olmas\u0131 gerekmektedir. Bu hallerde ifada zorlu\u011fa d\u00fc\u015fen taraf kira s\u00f6zle\u015fmesinin yeni ko\u015fullara uyarlanmas\u0131n\u0131 dava yoluyla talep edebilmektedir.<\/p>\n\n\n\n<p><strong>\u00d6ng\u00f6r\u00fclemeyen durumlar k\u0131saca,<\/strong><\/p>\n\n\n\n<p>&#8211; D\u00f6viz kurlar\u0131nda ola\u011fan\u00fcst\u00fc art\u0131\u015f,<\/p>\n\n\n\n<p>&#8211; Sava\u015f,<\/p>\n\n\n\n<p>&#8211; Pandemi,<\/p>\n\n\n\n<p>&#8211; Ekonomik kriz ve y\u00fcksek enflasyon, \u015feklinde \u00f6rneklendirilebilir.<\/p>\n\n\n\n<p>Bu dava her iki taraf\u00e7a a\u00e7\u0131labilece\u011fi gibi yukar\u0131da bahsetti\u011fimiz mecburi dava arkada\u015fl\u0131\u011f\u0131 burada da mevcuttur.<\/p>\n\n\n\n<p>Uyarlama davas\u0131 ileriye etkili bir davad\u0131r. Yani davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 andan itibaren kira bedelinde de\u011fi\u015fiklik talep edilebilmektedir. Daha \u00f6nce \u00f6denen kiralar y\u00f6n\u00fcnden herhangi bir talepte bulunulamamaktad\u0131r.<\/p>\n\n\n\n<p>Uyarlama davas\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli s\u00f6zle\u015fmeler i\u00e7in de a\u00e7\u0131labilmektedir. Bir y\u0131ldan uzun s\u00fcreli s\u00f6zle\u015fmelerde ise davay\u0131 a\u00e7abilmek i\u00e7in bir y\u0131l\u0131n dolmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi, 09.10.2019 tarihli, 2018\/5741 E. ve 2019\/7695 K. say\u0131l\u0131 karar\u0131nda<\/strong> <em>\u2018\u2019Davac\u0131 yeni malik, 07\/05\/2013 tarihinden itibaren ge\u00e7erli olmak \u00fczere de\u011fi\u015fen hal ve \u015fartlara g\u00f6re kira bedelinin uyarlanmas\u0131n\u0131 istemi\u015f ve 12\/09\/2013 tarihinde i\u015f bu davay\u0131 a\u00e7m\u0131\u015ft\u0131r. Uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde edimler aras\u0131ndaki dengenin a\u015f\u0131r\u0131 bozulmas\u0131 ve s\u00f6zle\u015fmenin taraflar a\u00e7\u0131s\u0131ndan \u00e7ekilmez hale gelmesi durumunda kira paras\u0131n\u0131n g\u00fcn\u00fcn ekonomik ko\u015fullar\u0131na uyarlanmas\u0131 i\u00e7in her zaman \u201c uyarlama \u201c davas\u0131 a\u00e7\u0131labilir.\u2019\u2019 \u015eeklinde h\u00fck\u00fcm kurmu\u015ftur.<\/em><\/p>\n\n\n\n<p><strong>Yetkili ve G\u00f6revli Mahkeme<\/strong><\/p>\n\n\n\n<p>Kira uyarlama davas\u0131nda g\u00f6revli ve yetkili mahkeme, s\u00f6zle\u015fmenin ifa yerindeki veya daval\u0131n\u0131n yerle\u015fim yerindeki<strong>Sulh Hukuk Mahkemesidir<\/strong>.<\/p>\n\n\n\n<p><strong>Zorunlu Arabuluculuk \u015eart\u0131<\/strong><\/p>\n\n\n\n<p>01.09.2023 tarihinden itibaren a\u00e7\u0131lacak kira uyarlama davalar\u0131nda dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurmak dava \u015fart\u0131 haline gelmi\u015ftir. Kira tespit davas\u0131 ise a\u00e7\u0131ld\u0131\u011f\u0131 andan sonraki d\u00f6nem i\u00e7in h\u00fck\u00fcm do\u011furmaktad\u0131r. Ancak kiraya veren, yeni kira d\u00f6neminden en ge\u00e7 30 g\u00fcn \u00f6nce, yeni d\u00f6nemde art\u0131\u015f yapaca\u011f\u0131na ili\u015fkin yaz\u0131l\u0131 ihtar g\u00f6nderirse yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur.<\/p>\n\n\n\n<p>&#8211; Uyarlama davas\u0131nda h\u00e2kimin takdiri mevcuttur. Talepten ayr\u0131 olarak uyarlamaya da h\u00fckmedebilir.
