Kiraya verenin, kiralanan\u0131 kirac\u0131ya teslim etme, kirac\u0131n\u0131n ise kiralanan\u0131n kullan\u0131m\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda anla\u015fm\u0131\u015f olduklar\u0131 bedeli kiraya verene \u00f6deme borcu vard\u0131r. Bu s\u00fcre\u00e7 kira ili\u015fkisi mevcut oldu\u011fu boyunca devam etmektedir. Kira ili\u015fkisi sonland\u0131\u011f\u0131nda ise bu kar\u015f\u0131l\u0131kl\u0131 s\u00f6zle\u015fme de son bulmakta ve kiralanan\u0131n tahliyesi mecburi olmaktad\u0131r. A\u015fa\u011f\u0131daki yaz\u0131m\u0131zda ise kirac\u0131dan kaynakl\u0131 sebeplerle olu\u015fan tahliye nedenlerine de\u011finece\u011fiz.<\/p>\n\n\n\n<p><strong>Kirac\u0131n\u0131n Yaz\u0131l\u0131 Bir Tahliye Taahh\u00fcd\u00fcnde Bulunmas\u0131<\/strong><\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu madde 352\u2019de d\u00fczenlenen kirac\u0131dan kaynakl\u0131 sebeplerle tahliye durumlar\u0131ndan biri de kirac\u0131n\u0131n, kiraya verene kar\u015f\u0131 kiralanan\u0131 tahliye edece\u011fini taahh\u00fct etmesidir. Bu verilen taahh\u00fcd\u00fcn belli ba\u015fl\u0131 \u015fekil \u015fartlar\u0131 oldu\u011fu gibi bu \u015fartlar\u0131 sa\u011flamayan tahliye taahh\u00fctnamesinin ge\u00e7erlili\u011fi olmayacakt\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00d6ncelikle s\u00f6z konusu taahh\u00fctte bulunan ki\u015fi kirac\u0131 olmal\u0131d\u0131r. Veya kirac\u0131 yetkili temsilcisi vas\u0131tas\u0131 ile tahliye taahh\u00fcd\u00fcnde bulunmu\u015f olmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesinde yaz\u0131l\u0131 \u015fart aranmazken, kirac\u0131 taraf\u0131ndan tahliye taahh\u00fcd\u00fcnde bulunulmas\u0131 yaz\u0131l\u0131 \u015fekil \u015fart\u0131na ba\u011fl\u0131d\u0131r. Yani s\u00f6z konusu tahliye yaz\u0131l\u0131 olarak d\u00fczenlenmi\u015f ve imzalanm\u0131\u015f olmal\u0131d\u0131r. Adi yaz\u0131l\u0131 \u015fekilde d\u00fczenlenmi\u015f olmas\u0131 yeterli olmaktad\u0131r. Ancak tahliye zaman\u0131 geldi\u011finde kirac\u0131n\u0131n imzan\u0131n kendisine ait olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrd\u00fc\u011f\u00fc gibi durumlarla kar\u015f\u0131la\u015f\u0131lmaktad\u0131r. Bu gibi durumlara tak\u0131lmamak ad\u0131na s\u00f6z konusu taahh\u00fct noter vas\u0131tas\u0131 ile de d\u00fczenlenebilmektedir. Kirac\u0131n\u0131n birden fazla ki\u015fi olmas\u0131 durumunda, t\u00fcm kirac\u0131lar\u0131n tahliye taahh\u00fcd\u00fcnde bulunmas\u0131 gerekmektedir. Aksi durumda tahliye taahh\u00fctnamesi h\u00fck\u00fcm do\u011furmayacakt\u0131r.<\/li>\n\n\n\n<li>S\u00f6z konusu tahliye taahh\u00fcd\u00fcn\u00fc kirac\u0131n\u0131n tahliye tarihini a\u00e7\u0131k\u00e7a g\u00fcn ay y\u0131l belirtir \u015fekilde akdetmi\u015f olmas\u0131 gerekmektedir. Aksi takdirde taahh\u00fct ge\u00e7ersiz say\u0131lmaktad\u0131r. Uygulamada kar\u015f\u0131la\u015f\u0131lan durumlardan biri de taahh\u00fct tarihi ve imzalama tarihi k\u0131s\u0131mlar\u0131n\u0131n bo\u015f b\u0131rak\u0131larak sadece metne imza at\u0131lmas\u0131d\u0131r. Bu bo\u015f k\u0131s\u0131mlar\u0131n sonradan doldurulmas\u0131 ge\u00e7ersiz olmakla birlikte ispat hususu kirac\u0131ya aittir. Dolay\u0131s\u0131yla kirac\u0131 taraf\u0131ndan bu husus ispatlanamad\u0131\u011f\u0131 durumlarda tahliye taahh\u00fctnamesi ge\u00e7erli say\u0131larak i\u015flem g\u00f6rmektedir.<\/li>\n<\/ul>\n\n\n\n<p><strong>Yarg\u0131tay 12. Hukuk Dairesi E: 2020\/1175 K: 2020\/2309, 09.03.2020 tarihli karar\u0131nda<\/strong> <em>\u2018\u2019\u2019Kira s\u00fcresi 01.05.2012 tarihinden ba\u015flayarak 3+2 y\u0131l olarak kararla\u015ft\u0131r\u0131lm\u0131\u015f olup bu s\u00fcrenin sonunda kirac\u0131 mecuru bo\u015faltarak kiraya verene kay\u0131ts\u0131z \u015farts\u0131z teslim edecektir.\u2019 \u015eeklinde taahh\u00fcd\u00fcn yer ald\u0131\u011f\u0131, daval\u0131n\u0131n 01\/02\/2005 tarihli kira s\u00f6zle\u015fmesine g\u00f6re bu tarihten itibaren kiralanan ta\u015f\u0131nmazda bulundu\u011fu, s\u00f6z konusu taahh\u00fcd\u00fcn kira ili\u015fkisi devam ederken verilen tahliye taahh\u00fcd\u00fc oldu\u011fu ancak taahh\u00fcd\u00fcn belli bir tarihi i\u00e7ermedi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Tahliye taahh\u00fcd\u00fcnde, tahliye tarihi belli (a\u00e7\u0131k) bir \u015fekilde yer almad\u0131\u011f\u0131ndan T\u00fcrk Bor\u00e7lar Kanununun 352. maddesinin arad\u0131\u011f\u0131 anlamda bir tahliye taahh\u00fcd\u00fcn\u00fcn varl\u0131\u011f\u0131ndan bahsedilemez.\u2019\u2019 <\/em>\u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u015eartlardan biri de tahliye taahh\u00fcd\u00fcn\u00fcn, kira s\u00f6zle\u015fmesinin imzaland\u0131\u011f\u0131 g\u00fcnden daha sonraki g\u00fcnlerde ve kiralanan\u0131n tesliminden sonra imzalanm\u0131\u015f olmas\u0131d\u0131r. Kira s\u00f6zle\u015fmesinden \u00f6nce veya ayn\u0131 g\u00fcnde veyahut kiralanan\u0131n tesliminden \u00f6nce yap\u0131lm\u0131\u015f olan tahliye taahh\u00fctnamesi ge\u00e7ersiz olarak de\u011ferlendirilmektedir. Bunun sebebi ise kira ili\u015fkisi kurulmadan veya kurulurken verilen tahliye taahh\u00fcd\u00fcn\u00fcn serbest bir iradeye dayanmamas\u0131 gerek\u00e7e g\u00f6sterilmektedir. \u00c7\u00fcnk\u00fc kirac\u0131, kira ili\u015fkisi kurabilmek i\u00e7in zorunlu olarak tahliye taahh\u00fcd\u00fc vermek zorunda kalacakt\u0131r.<\/li>\n<\/ul>\n\n\n\n<p>Kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi (tahliye taahh\u00fctnamesi imzalam\u0131\u015fsa) halde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir. Belirtmek gerekir ki bu bir ayl\u0131k s\u00fcre hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcredir ve ba\u015fvuru hakk\u0131 s\u00fcresinde kullan\u0131lmazsa tahliye taahh\u00fcd\u00fcne dayal\u0131 tahliye talep etme hakk\u0131 d\u00fc\u015fer.<\/p>\n\n\n\n<p><strong>Bildirim Yolu \u0130le Kirac\u0131n\u0131n Tahliyesi<\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmeleri belirli ve belirsiz s\u00fcreli olmak \u00fczere ikiye ayr\u0131lmaktad\u0131r. Buna g\u00f6re \u015fayet taraflar s\u00f6zle\u015fmede bir s\u00fcre \u00f6ng\u00f6rm\u00fc\u015flerse, kira s\u00f6zle\u015fmesinin belirli s\u00fcreli oldu\u011fu kabul edilir. Bununla birlikte, taraflar s\u00f6zle\u015fmede herhangi bir s\u00fcre \u00f6ng\u00f6rmemi\u015flerse, kira s\u00f6zle\u015fmesinin belirsiz s\u00fcreli oldu\u011fu s\u00f6ylenebilecektir. Bildirim yoluyla kirac\u0131n\u0131n tahliye edilmesi i\u00e7in s\u00f6zle\u015fmenin t\u00fcr\u00fc \u00f6nem arz etmektedir. Bu sebeple belirli ve belirsiz s\u00fcreli s\u00f6zle\u015fmelerde tahliye ayr\u0131 ayr\u0131 ele al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p><strong>Belirli S\u00fcreli Kira S\u00f6zle\u015fmelerinde<\/strong><\/p>\n\n\n\n<p>Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemi ve bildirim s\u00fcrelerine uyarak kira s\u00f6zle\u015fmesini sona erdirebilirken, kiraya veren ise 10 y\u0131ll\u0131k uzama s\u00fcresinin sonunda bu imkandan faydalanabilmektedir. On y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzam y\u0131l\u0131n\u0131n bitiminden en az 3 ay \u00f6nce yaz\u0131l\u0131 olarak kirac\u0131ya bildirimde bulunmak \u015fart\u0131yla sebep g\u00f6stermeksizin kira s\u00f6zle\u015fmesini feshedebilecektir.<\/p>\n\n\n\n<p><strong>Belirsiz S\u00fcreli Kira S\u00f6zle\u015fmelerinde<\/strong><\/p>\n\n\n\n<p>Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde ise kirac\u0131 her zaman genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemi ve bildirim s\u00fcrelerine uyarak kira s\u00f6zle\u015fmesini sona erdirebilirken, bu hak kiraya verene verilmemi\u015ftir. Kiraya veren ancak 10 y\u0131l\u0131n sonunda hi\u00e7bir neden belirtmeksizin sona erdirebilme hakk\u0131na sahiptir. Kiraya veren 10 y\u0131l ge\u00e7tikten sonra, 6 ayl\u0131k fesih d\u00f6neminin sonunda ge\u00e7erli olacak \u015fekilde en az 3 ay \u00f6nceden kiraya verene yaz\u0131l\u0131 bildirimde bulunarak s\u00f6zle\u015fmeyi feshedebilir. S\u00f6zle\u015fmede veya kanunda belirtilen fesih d\u00f6nemine veya bildirim s\u00fcresine uyulmam\u0131\u015fsa, bildirim bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olur.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi E. 2017\/7129 K. 2017\/17713, 14.12.2017 tarihli karar\u0131nda<\/strong> \u2018\u2019T\u00fcrk Bor\u00e7lar Kanunu madde 328\u2019de ; \u2018S\u00f6zle\u015fmede veya kanunda belirtilen fesih d\u00f6nemine veya bildirim s\u00fcresine uyulmam\u0131\u015fsa, bildirim bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olur.\u2019 d\u00fczenlemesi bulunmaktad\u0131r. Bu durumda daval\u0131ya 09.01.2015 tarihinde tebli\u011f edilen ihtar T\u00fcrk Bor\u00e7lar Kanunu madde 328 uyar\u0131nca bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olaca\u011f\u0131ndan, fesih bildiriminin alt\u0131 ayl\u0131k kira d\u00f6neminin sonu i\u00e7in \u00fc\u00e7 ayl\u0131k fesih bildirim s\u00fcresine uyularak yap\u0131ld\u0131\u011f\u0131 ve davan\u0131n s\u00fcresinde a\u00e7\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmakla i\u015fin esas\u0131n\u0131n incelenmesi gerekirken, davan\u0131n s\u00fcre y\u00f6n\u00fcnden reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir.\u2019\u2019 \u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<p><strong>Fesih Bildirimi<\/strong><\/p>\n\n\n\n<p>Fesih bildirimi yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gerekmektedir. Yaz\u0131l\u0131 fesih bildirimine ra\u011fmen kirac\u0131 kiralanan\u0131 tahliye etmekte direnirse, duruma g\u00f6re ilaml\u0131 ya da ilams\u0131z icra takibi yolu ile tahliye s\u00f6z konusu olmaktad\u0131r. Burada ispat a\u00e7\u0131s\u0131ndan yegane makul yol; noter vas\u0131tas\u0131yla ihtarname g\u00f6nderilmesidir.<\/p>\n\n\n\n<p><strong>Kirac\u0131n\u0131n veya E\u015finin Ayn\u0131 \u0130l\u00e7ede Konutunun Bulunmas\u0131 Sebebiyle Tahliye<\/strong><\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu 352. Madde 3. F\u0131kras\u0131nda ise kirac\u0131n\u0131n veya e\u015finin ayn\u0131 il\u00e7ede konutunun bulunmas\u0131n\u0131 kirac\u0131dan kaynakl\u0131 tahliye sebebi olarak de\u011ferlendirmi\u015ftir. \u00d6zetle kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin ayn\u0131 il\u00e7e veya belde belediye s\u0131n\u0131rlar\u0131 i\u00e7inde oturmaya elveri\u015fli bir konutu bulunmas\u0131 durumunda kiraya veren, kira s\u00f6zle\u015fmesinin kurulmas\u0131 s\u0131ras\u0131nda bunu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden ba\u015flayarak bir ay i\u00e7inde s\u00f6zle\u015fmeyi dava yoluyla sona erdirebilir. Ancak kiraya veren s\u00f6zle\u015fmenin kurulmas\u0131 s\u0131ras\u0131nda bu konuttan haberdar olmas\u0131na ra\u011fmen s\u00f6zle\u015fmeyi imzalam\u0131\u015fsa s\u00f6zle\u015fme bu sebebe dayal\u0131 olarak feshedilemeyecektir.<\/p>\n\n\n\n<p><strong>\u0130ki Hakl\u0131 \u0130htar Sebebiyle Tahliye<\/strong><\/p>\n\n\n\n<p>Kirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir<\/p>\n\n\n\n<p>\u0130ki Hakl\u0131 \u0130htar Sebebiyle Tahliye adl\u0131 daha detayl\u0131 yaz\u0131m\u0131za buradan ula\u015fabilirsiniz.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kirac\u0131dan Kaynaklanan Sebeplerle Tahliye T\u00fcrk Bor\u00e7lar Kanunu\u2019nda d\u00fczenlenmi\u015f olan kira s\u00f6zle\u015fmesi tam iki tarafa bor\u00e7 y\u00fckleyen r\u0131zaya dayal\u0131 bir s\u00f6zle\u015fmedir.
