Kira ili\u015fkisi devam etti\u011fi s\u0131rada kiraya verenin ve kiralanan\u0131n zarar g\u00f6rmesini \u00f6nlemek amac\u0131yla bu bor\u00e7 T\u00fcrk Bor\u00e7lar Kanunu 316. maddesinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p><strong>\u00d6zenle Kullanma ve Kom\u015fulara Sayg\u0131 G\u00f6sterme Borcu<\/strong><\/p>\n\n\n\n<p>TBK m. 316 <em>\u2018\u2019Kirac\u0131, kiralanan\u0131, s\u00f6zle\u015fmeye uygun olarak \u00f6zenle kullanmak ve kiralanan\u0131n bulundu\u011fu ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fulara gerekli sayg\u0131y\u0131 g\u00f6stermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n\n\n\n<p><em>Kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davranmas\u0131 durumunda kiraya veren, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131nda, en az otuz g\u00fcn s\u00fcre vererek, ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi, aksi takdirde s\u00f6zle\u015fmeyi feshedece\u011fi konusunda yaz\u0131l\u0131 bir ihtarda bulunur. Di\u011fer kira ili\u015fkilerinde ise, kiraya veren, kirac\u0131ya \u00f6nceden bir ihtarda bulunmaks\u0131z\u0131n, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.<\/em><\/p>\n\n\n\n<p><em>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131nda, kirac\u0131n\u0131n kiralanana kasten a\u011f\u0131r bir zarar vermesi, kirac\u0131ya verilecek s\u00fcrenin yarars\u0131z olaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 veya kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davran\u0131\u015f\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan \u00e7ekilmez olmas\u0131 durumlar\u0131nda kiraya veren, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.\u2019\u2019<\/em><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Kirac\u0131n\u0131n Kiralanan\u0131 \u00d6zenle Kullanma Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne Ayk\u0131r\u0131 Davranmas\u0131<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Kirac\u0131, kiralanan\u0131 s\u00f6zle\u015fme ile anla\u015f\u0131lm\u0131\u015f olan tahsis amac\u0131na uygun ve \u00f6zenle kullanmak, korumak zorundad\u0131r. Kiralanan\u0131n kullan\u0131m\u0131ndan kaynakl\u0131 olan, rutin durumda ortaya \u00e7\u0131kan temizlik ve bak\u0131m giderlerini kar\u015f\u0131lamak zorundad\u0131r. Ola\u011fan d\u0131\u015f\u0131, y\u00fck\u00fcml\u00fc olmad\u0131\u011f\u0131 durumlar\u0131 ise kiraya verene bildirmek zorundad\u0131r.<\/p>\n\n\n\n<p>\u00d6zenle kullanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn gerekliliklerinden biri de kom\u015fulara sayg\u0131 g\u00f6sterme borcudur. Kiralananda ikamet eden kirac\u0131, ta\u015f\u0131nmazda ikamet eden kom\u015fular\u0131na kar\u015f\u0131 sayg\u0131 ve \u00f6zenle hareket etmelidir. Kiralananda huzursuzluk \u00e7\u0131karmamas\u0131, kom\u015fular\u0131n\u0131 rahats\u0131z edecek \u015fekilde g\u00fcr\u00fclt\u00fc yapmamas\u0131, kom\u015fular\u0131n mallar\u0131na zarar vermemesi gerekmektedir.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 3. HD., E. 2017\/8259 K. 2018\/189 T. 16.1.2018<\/strong> say\u0131l\u0131 karar\u0131nda, kom\u015fular\u0131n\u0131n mallar\u0131na zarar veren kirac\u0131 ile olan s\u00f6zle\u015fmenin kiralayan taraf\u0131ndan ihtara gerek duyulmadan feshedebilece\u011fi, \u015feklinde h\u00fck\u00fcm kurmu\u015ftur.<\/p>\n\n\n\n<p>\u00d6zenle kullanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kanunda genel bir ifade ile belirtilmi\u015ftir. Detayland\u0131r\u0131lmas\u0131 ve hangi durumlar\u0131n \u00f6zenle kullanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fu Yarg\u0131tay i\u00e7tihatlar\u0131 ile belirlenmi\u015ftir. Bu durumlara \u00f6rnek verecek olursak, konut olarak kiralanm\u0131\u015f bir ta\u015f\u0131nmaz\u0131n s\u00f6zle\u015fmeye ayk\u0131r\u0131 olarak kumarhane olarak kullan\u0131lmas\u0131, market olarak kiralanan i\u015f yerinin nalbur olarak kullan\u0131lmas\u0131 gibi durumlar, kiralanan\u0131n s\u00f6zle\u015fmede \u00f6zg\u00fclenen amac\u0131 d\u0131\u015f\u0131nda kullan\u0131ld\u0131\u011f\u0131 kabul edilir.<\/p>\n\n\n\n<p>Bunun yan\u0131nda Yarg\u0131tay i\u00e7tihatlar\u0131 incelendi\u011finde, kiralanan\u0131 \u00f6zg\u00fclenen ama\u00e7 do\u011frultusunda kullan\u0131lsa bile, kiralanana zarar verilmesi, rutin temizlik ve bak\u0131mlar\u0131n\u0131n yap\u0131lmamas\u0131, balkon duvarlar\u0131n\u0131 y\u0131karak odan\u0131n geni\u015fletilmesi gibi durumlar da kiralanan\u0131n \u00f6zenle kullan\u0131lmamas\u0131 durumlar\u0131 olarak nitelendirilir.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kirac\u0131n\u0131n Kiralanan\u0131 \u00d6zenle Kullanma Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne Ayk\u0131r\u0131 Davranmas\u0131 Sonucu Tahliye Davas\u0131<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Kirac\u0131n\u0131n \u00f6zenle kullanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davranmas\u0131 gibi durumlarda s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k sebebiyle konut ve \u00e7at\u0131l\u0131 i\u015f yerlerine ait s\u00f6zle\u015fmeyi feshedebilmesi i\u00e7in en az otuz g\u00fcn s\u00fcre vererek, ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi istedi\u011fi aksi takdirde s\u00f6zle\u015fmeyi feshedece\u011fi konusunda yaz\u0131l\u0131 ihtarda bulunmas\u0131 gerekmektedir. Di\u011fer kira ili\u015fkilerinde ise, kiraya veren, kirac\u0131ya \u00f6nceden bir ihtarda bulunmaks\u0131z\u0131n, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.<\/p>\n\n\n\n<p>Kira ili\u015fkisini sonland\u0131ran kiraya veren dava a\u00e7arak kirac\u0131y\u0131 tahliye edebilir. Bu dava kirac\u0131n\u0131n yerle\u015fim yerindeki sulh hukuk mahkemelerinde a\u00e7\u0131lmaktad\u0131r. Ancak dava a\u00e7madan \u00f6nce arabuluculuk ba\u015fvurusu yap\u0131l\u0131p s\u00fcrecin tamamlanmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Ayr\u0131ca belirtmek gerekir ki, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmelerinde a\u00e7\u0131ktan fena kullan\u0131m durumunda kirac\u0131ya herhangi bir ihtar g\u00f6nderilmeksizin kiraya veren tahliye davas\u0131 a\u00e7abilmektedir. TBK m. 316 f\u0131kra 3\u2019e g\u00f6re a\u00e7\u0131ktan fena kullan\u0131m halleri ve ihtara gerek duyulmayan durumlar, kirac\u0131n\u0131n kiralanana kasten a\u011f\u0131r bir zarar vermesi, kirac\u0131ya s\u00fcre verilmesi durumunda bu s\u00fcrenin yarars\u0131z olaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 veya kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davran\u0131\u015f\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan \u00e7ekilmez olmas\u0131 \u015feklinde s\u0131ralanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Yarg\u0131tay i\u00e7tihatlar\u0131nda a\u00e7\u0131ktan fena kullan\u0131m olarak say\u0131lan ihtara gerek duyulmayan durumlardan baz\u0131lar\u0131 ise,&nbsp; kirac\u0131n\u0131n kiraya verene k\u00fcf\u00fcr etmesi, kirac\u0131n\u0131n kiralanana ka\u00e7ak priz hatt\u0131, ka\u00e7ak elektrik \u00e7ekmesi, kiralananda fuhu\u015f yap\u0131lmas\u0131d\u0131r.<strong>Yarg\u0131tay HGK., E. 2017\/1770 K. 2021\/1738 T. 23.12.2021<\/strong> say\u0131l\u0131 karar\u0131nda, Kirac\u0131 ile kiraya veren aras\u0131nda ceza davalar\u0131 varsa, kira ili\u015fkisi \u00e7ekilmez hale gelece\u011finden tahliye karar\u0131 verilmelidir, \u015feklinde h\u00fck\u00fcm kurmu\u015ftur<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kira s\u00f6zle\u015fmeleri iki tarafa bor\u00e7 y\u00fckleyen s\u00f6zle\u015fmelerdir.
