G\u00fcn\u00fcm\u00fczde zorla\u015fan ekonomik ko\u015fullar nedeniyle bu sorun kar\u015f\u0131m\u0131za \u00e7ok fazla \u00e7\u0131kmaya ba\u015flam\u0131\u015ft\u0131r. A\u015fa\u011f\u0131daki yaz\u0131m\u0131zda, kira bedelinin \u00f6denmemesi sebebiyle olu\u015fan temerr\u00fcd ve akabinde ger\u00e7ekle\u015fen tahliye \u015fartlar\u0131na de\u011finilecektir.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Kirac\u0131n\u0131n Temerr\u00fcd\u00fc<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Genellikle kiralanan\u0131n kira bedeli, hangi g\u00fcn veya g\u00fcnlerde \u00f6denece\u011fi kira s\u00f6zle\u015fmesinin yap\u0131lmas\u0131 s\u0131ras\u0131nda kararla\u015ft\u0131r\u0131lmaktad\u0131r. Ancak bu s\u0131rada herhangi bir kararla\u015ft\u0131rma yap\u0131lmam\u0131\u015f ise TBK madde 314\u2019e g\u00f6re <em>\u2018\u2019Kirac\u0131, aksine s\u00f6zle\u015fme ve yerel \u00e2det olmad\u0131k\u00e7a, kira bedelini ve gerekiyorsa yan giderleri, her ay\u0131n sonunda ve en ge\u00e7 kira s\u00fcresinin bitiminde \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.\u2019\u2019 <\/em>Yani kararla\u015ft\u0131r\u0131lm\u0131\u015f olan tarihte veyahut kararla\u015ft\u0131r\u0131lmamas\u0131 durumunda kanundaki s\u00fcrelere uyalarak kira bedelinin \u00f6denmesi gerekmektedir. Bu bedelin zaman\u0131nda \u00f6denmemesi durumunda kirac\u0131 temerr\u00fcde d\u00fc\u015fmektedir. Kirac\u0131n\u0131n temerr\u00fcd\u00fc TBK madde 315\u2019de <em>\u2018\u2019Kirac\u0131, kiralanan\u0131n tesliminden sonra muaccel olan kira bedelini veya yan gideri \u00f6deme borcunu ifa etmezse, kiraya veren kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verip, bu s\u00fcrede de ifa etmeme durumunda, s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir.\u2019\u2019<\/em> \u015feklinde d\u00fczenlenmi\u015ftir. Bu feshetme sonucunda kiraya veren kirac\u0131y\u0131 tahliye edebilecektir.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kira Bedelinin \u00d6denmemesi Nedeniyle Tahliye<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Yukar\u0131da da de\u011finmi\u015f oldu\u011fumuz, TBK madde 315 gere\u011fi kirac\u0131n\u0131n temerr\u00fcd\u00fc sebebiyle kira s\u00f6zle\u015fmesinin sona erdilerek kiralanan\u0131n tahliyesi m\u00fcmk\u00fcnd\u00fcr. Kirac\u0131n\u0131n \u00f6deme s\u00fcresi i\u00e7erisinde, kira bedelini ve yan giderleri \u00f6dememi\u015f olmas\u0131 gerekmektedir. Bu durumda kiraya veren, kirac\u0131ya ihtarname g\u00f6nderip belirli bir s\u00fcre vererek, verilen s\u00fcre i\u00e7erisinde kira veya yan giderleri \u00f6dememesi durumunda s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir.<\/p>\n\n\n\n<p>Kirac\u0131ya verilecek olan s\u00fcre en az on g\u00fcn, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise en az otuz g\u00fcnd\u00fcr. Bu s\u00fcre, kirac\u0131ya yaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 tarihi izleyen g\u00fcnden itibaren i\u015flemeye ba\u015flar. Kirac\u0131 verilen s\u00fcre i\u00e7erisinde geciken kira bedelini \u00f6demez veyahut eksik \u00f6derse kira d\u00f6neminin sonu beklenmeden temerr\u00fct nedeni ile sulh hukuk mahkemelerinde tahliye davas\u0131 a\u00e7\u0131labilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p><a href=\"https:\/\/karararama.yargitay.gov.tr\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Yarg\u0131tay<\/strong><\/a><strong>&nbsp;6. Hukuk Dairesi 2015\/6655 Esas, 2015\/10585 Karar numaral\u0131 ve 01.12.2015 tarihli karar\u0131nda,<\/strong> 35 kuru\u015f \u00f6demede temerr\u00fcde d\u00fc\u015fen kirac\u0131n\u0131n temerr\u00fct nedeniyle tahliye davas\u0131 sonucu tahliye edilmesi gerekti\u011fine h\u00fckmetmi\u015ftir.<\/p>\n\n\n\n<p>Yarg\u0131tay\u2019\u0131n vermi\u015f oldu\u011fu karar incelendi\u011finde \u00f6denmeyen ya da miktar ne olursa olsun eksik \u00f6denen kira bedeli hakl\u0131 tahliye sebebi olu\u015fturmaktad\u0131r.<\/p>\n\n\n\n<p>Kiraya veren ayr\u0131ca temerr\u00fct faizi de talep edebilmektedir. Kiraya veren temerr\u00fct faizini as\u0131l kira bedeli alaca\u011f\u0131 ile isteyebilece\u011fi gibi bu alacak sona ermeden ayr\u0131 bir dava ile de talep edebilir. Bu faiz kiracn\u0131n\u0131n temerr\u00fcde d\u00fc\u015ft\u00fc\u011f\u00fc tarihten itibaren i\u015flemeye ba\u015flayacakt\u0131r. Kirac\u0131 bildirimde bulunulan kira bedeli borcunu kendisine verilmi\u015f olan s\u00fcre i\u00e7erisinde \u00f6demesi durumunda, kiraya verenin fesih hakk\u0131 ortadan kalkmaktad\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Kiraya veren, TBK madde 352\u2019ye dayanarak, kira bedelinin \u00f6denmemesi ya da ge\u00e7 \u00f6denmesi nedeniyle bir kira y\u0131l\u0131 i\u00e7erisinde yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarname g\u00f6nderdi\u011fi kirac\u0131 aleyhine tahliye davas\u0131 a\u00e7mas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi E: 2017\/14760 K: 2017\/13258 T: 04.10.2017 <\/strong><strong>say\u0131l\u0131 karar\u0131nda<\/strong>; <em>\u2018\u2019\u2026somut olayda icra takibinde talep edilen alacak ile ihtarnamede talep edilen alacak ayn\u0131 kira d\u00f6nemine ait olmad\u0131\u011f\u0131ndan iki hakl\u0131 ihtar \u015fart\u0131 da olu\u015fmam\u0131\u015ft\u0131r.\u2019\u2019<\/em> Karar incelendi\u011finde kira bedeli \u00f6denmemesi sebebiyle g\u00f6nderilen iki hakl\u0131 ihtarname bir kira y\u0131l\u0131 i\u00e7erisindeki aylara ait olmas\u0131 gerekti\u011fi g\u00f6r\u00fclmektedir.<strong><\/strong><\/p>\n\n\n\n<p>\u0130htar edilen kira bedelinin hangi aya ili\u015fkin oldu\u011fu a\u00e7\u0131k\u00e7a belirtilmi\u015f olmal\u0131d\u0131r. Buradaki ihtara konu aylar iki farkl\u0131 ay olmak zorundad\u0131r. Ayn\u0131 aya ili\u015fkin iki farkl\u0131 ihtar g\u00f6nderilmesi bu \u015fart\u0131 ge\u00e7erli k\u0131lmamaktad\u0131r. Kiraya veren, kirac\u0131ya g\u00f6nderecek oldu\u011fu ihtar\u0131 yaz\u0131l\u0131 \u015fekilde yapmak mecburiyetindedir. Bu yaz\u0131l\u0131 \u015fart\u0131 ispatlaman\u0131n kolay olmas\u0131 a\u00e7\u0131s\u0131ndan uygulamada ihtarname noter arac\u0131l\u0131\u011f\u0131 ile g\u00f6nderilmektedir.<\/p>\n\n\n\n<p>\u0130ki hakl\u0131 ihtar sebebiyle a\u00e7\u0131lacak olan tahliye davas\u0131 ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde sulh hukuk mahkemelerinde a\u00e7\u0131lmas\u0131 gerekmektedir. \u0130htar sonucunda yap\u0131lan \u00f6demeler iki hakl\u0131 ihtar\u0131n olu\u015fmas\u0131na engel te\u015fkil etmemektedir. Dolay\u0131s\u0131yla ihtar sonras\u0131nda \u00f6deme yap\u0131lm\u0131\u015f olsa bile iki hakl\u0131 ihtar sebebiyle tahliye davas\u0131 a\u00e7mak m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kira Bedelinin \u00d6denmemesi Sonras\u0131 Tahliye Talepli \u0130cra Takibi ile Tahliye<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Bir ba\u015fka yol olan, kiraya verenin \u00f6denmemi\u015f olan kira borcuna ili\u015fkin \u0130\u0130K madde 269 ve devam\u0131 gere\u011fince tahliye talepli icra takibi ba\u015flat\u0131lmas\u0131d\u0131r. Burada dikkat edilmesi gereken husus icra takibinde tahliye talebinde bulunulmas\u0131d\u0131r. Tahliye talebinde bulunulmaz ise kirac\u0131n\u0131n tahliyesi yap\u0131lamayacakt\u0131r.<\/p>\n\n\n\n<p>Tahliye talepli icra takibinde kiray\u0131 \u00f6demeyen kirac\u0131ya itiraz i\u00e7in yedi g\u00fcn s\u00fcre verilmektedir. \u00d6deme i\u00e7in iseon g\u00fcn, konut ve \u00e7at\u0131l\u0131 i\u015fyerlerinde ise otuz g\u00fcnl\u00fck s\u00fcre verilmektedir. Bu s\u00fcre i\u00e7erisinde itirazda bulunmayan kirac\u0131 kira akdini ve borcu kabul etmi\u015f say\u0131lmaktad\u0131r. S\u00f6z konusu bedelin eksin \u00f6denmesi veyahut \u00f6denmemesi durumunda ise kiraya veren \u00f6deme s\u00fcresinin bitiminden itibaren icra mahkemelerinde alt\u0131 ay i\u00e7inde tahliye davas\u0131 a\u00e7abilmektedir.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olmas\u0131 zorunlu bir unsur de\u011fildir ancak kiraya veren, kira s\u00f6zle\u015fmesinin s\u00f6zl\u00fc olarak yap\u0131ld\u0131\u011f\u0131n\u0131 takip talebinde belirtmelidir. Kirac\u0131, \u00f6deme emrine itiraz ederek kira s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131n\u0131 inkar ederse, kiraya verenin sulh hukuk mahkemesinde dava a\u00e7mas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Kirac\u0131 e\u011fer kira s\u00f6zle\u015fmesini veya \u00fczerindeki imzay\u0131 reddeder ise kiraya veren, noterde d\u00fczenlenmi\u015f veya imzas\u0131 tasdik edilmi\u015f bir senet ile veya kira s\u00f6zle\u015fmesi ile icra mahkemesine ba\u015fvurarak, itiraz\u0131n kald\u0131r\u0131lmas\u0131n\u0131 talep edebilir. Kiraya veren bu belgelere sahip de\u011fil ise s\u00f6z konusu kira bedelinin \u00f6denmesi ve tahliye davas\u0131 i\u00e7in sulh hukuk mahkemelerine ba\u015fvurabilecektir.<\/p>\n\n\n\n<p>Kiraya verenin, kirac\u0131n\u0131n itirazlar\u0131 sonras\u0131 yetkili mahkemelere ba\u015fvurabilmesi i\u00e7in alt\u0131 ayl\u0131k bir s\u00fcresi vard\u0131r.
