Ancak \u00f6zellikle konut ve i\u015fyerleri a\u00e7\u0131s\u0131ndan kira s\u00f6zle\u015fmelerinin \u201cyaz\u0131l\u0131\u201d \u015fekilde yap\u0131lmas\u0131n\u0131n \u00f6nemi b\u00fcy\u00fckt\u00fcr.<\/p>\n\n\n\n<p><strong>Kira S\u00f6zle\u015fmesinde Dikkat Edilecek Hususlar<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00d6ncelikle s\u00f6zle\u015fme konusu mecurun t\u00fcm nitelikleri karma\u015f\u0131kl\u0131\u011fa yol a\u00e7mayacak nitelikte s\u00f6zle\u015fmeye yaz\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Mecurun kira s\u00f6zle\u015fmesi akdedildi\u011fi s\u0131radaki durumu s\u00f6zle\u015fmede belirtilmeli ve sonradan \u00e7\u0131kabilecek ihtilaflar\u0131n \u00f6n\u00fcne ge\u00e7ilmelidir.<\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesi birden \u00e7ok sayfadan olu\u015fuyorsa taraflar\u0131n her sayfaya imza atmas\u0131 sa\u011flanmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesinde kefil al\u0131nacaksa kefalet s\u00fcresi mutlaka belirlenmelidir. \u201cKira s\u00f6zle\u015fmesi devam etti\u011fi m\u00fcddet\u00e7e\u201d \u015feklinde bir s\u00fcre belirlenmi\u015f say\u0131lmaz. Net olarak bir zaman aral\u0131\u011f\u0131 ve kefilin sorumlu oldu\u011fu tutar yaz\u0131lmad\u0131k\u00e7a kefalet ge\u00e7ersiz olacakt\u0131r.<\/li>\n\n\n\n<li>Depozito bedeli ve nakit mi yoksa k\u0131ymetli evrak olarak m\u0131 teslim al\u0131nd\u0131\u011f\u0131 belirtilmelidir.<\/li>\n\n\n\n<li>Ola\u011fan kullan\u0131mdan do\u011fan y\u0131pranmalar hari\u00e7 olmak \u00fczere meydana gelecek ar\u0131zalardan ve masraf unsurlar\u0131ndan do\u011facak masraflardan hangi taraf\u0131n sorumlu olaca\u011f\u0131 yaz\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Faydal\u0131 ve l\u00fcks giderler karine olarak Kirac\u0131ya ait olmakla beraber aksi kararla\u015ft\u0131r\u0131lacaksa muhakkak bu durum s\u00f6zle\u015fmede belirtilmelidir.<\/li>\n\n\n\n<li>Kirac\u0131 a\u00e7\u0131s\u0131ndan \u00e7ok \u00f6nemli olmamakla beraber kiralayan a\u00e7\u0131s\u0131ndan s\u00f6zle\u015fmenin fesih s\u00fcresinin atiye kalmamas\u0131 i\u00e7in kira s\u00f6zle\u015fmesi azami 1 y\u0131ll\u0131k imzalanmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira bedelinin yat\u0131r\u0131laca\u011f\u0131 hesap mutlaka kiraya verene ait olmal\u0131 ve hesap bilgileri s\u00f6zle\u015fmede yer almal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira bedelinin net mi br\u00fct m\u00fc oldu\u011fu s\u00f6zle\u015fmeye yaz\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>E\u011fer \u00f6denecek bir aidat varsa \u00f6denmemesi durumunda sorumlulu\u011fun yaln\u0131zca kat maliklerine de\u011fil kiralayana kar\u015f\u0131 da oldu\u011fu hususu belirtilmelidir.<\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesiyle ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmelerin ge\u00e7ersiz olaca\u011f\u0131 unutulmamal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira art\u0131\u015f\u0131 en fazla \u00dcFE oran\u0131nda yap\u0131labilecek olup aksine s\u00f6zle\u015fme h\u00fck\u00fcmleri ge\u00e7ersizdir.<\/li>\n\n\n\n<li>S\u00f6zle\u015fmede art\u0131\u015f ko\u015fulu varsa sadece s\u00f6zle\u015fme s\u00fcresi olan 1 y\u0131l i\u00e7in de\u011fil s\u00f6zle\u015fmenin yenilendi\u011fi her y\u0131l i\u00e7in ge\u00e7erli oldu\u011fu hususunun yaz\u0131lmas\u0131 gerekir.<\/li>\n<\/ul>\n\n\n\n<p><strong>Kira \u0130li\u015fkisinde Dikkat Edilecek Hususlar<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kiralayan\u0131n tahliye taahh\u00fcd\u00fc almas\u0131 durumunda bu taahh\u00fcd\u00fcn ge\u00e7erlili\u011fi, kira s\u00f6zle\u015fmesinin akdinden itibaren en az 1 ay ge\u00e7tikten sonra yap\u0131lmas\u0131na ba\u011fl\u0131d\u0131r.<\/li>\n\n\n\n<li>Depozito, kiralayan taraf\u0131ndan vadeli mevduat hesab\u0131na yat\u0131r\u0131lmal\u0131 ve de\u011feri korunmal\u0131d\u0131r. Aksi takdirde ya\u015fanacak de\u011fer kay\u0131plar\u0131ndan kiralayan sorumlu olacakt\u0131r.<\/li>\n\n\n\n<li>Ayn\u0131 kira y\u0131l\u0131 i\u00e7erisinde kira bedelinin iki sefer geciktirilmesi sebebiyle iki hakl\u0131 ihtara yol a\u00e7\u0131lmas\u0131 durumunda tahliye davas\u0131, ilgili kira y\u0131l\u0131n\u0131n bitiminden 1 ay i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r.<\/li>\n\n\n\n<li>S\u00f6zle\u015fmeye ayk\u0131r\u0131 kullan\u0131m durumunda kiralayan kirac\u0131ya ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi i\u00e7i 1 ayl\u0131k s\u00fcre verir, ayk\u0131r\u0131l\u0131k giderilmezse tahliye davas\u0131 a\u00e7\u0131labilir. \u00d6rne\u011fin s\u00fcrekli olarak kom\u015fular rahats\u0131zl\u0131k veren kirac\u0131 a\u00e7\u0131s\u0131ndan bu madde uygulanabilir.<\/li>\n\n\n\n<li>5 y\u0131lda bir kira uyarlama davas\u0131 a\u00e7\u0131larak kira bedelinin g\u00fcnl\u00fck ko\u015fullara g\u00f6re yeniden tespit edilmesi istenebilir.<\/li>\n\n\n\n<li>Kiralananda ay\u0131p meydana gelmesi durumunda kirac\u0131 evvela ay\u0131b\u0131n giderilmesi i\u00e7in kiralayana s\u00fcre verir, akabinde ay\u0131p giderilmezse kirac\u0131 kendisi ay\u0131b\u0131 gidererek bedelin kira bedelinden indirir.<\/li>\n\n\n\n<li>Ola\u011fan kullan\u0131mdan dolay\u0131 ortaya \u00e7\u0131kan eskime ve y\u0131pranmalara kiralayan katlanmak zorundad\u0131r.<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n kiralayanda de\u011fi\u015fiklik yapmas\u0131 ancak kiralayan\u0131n yaz\u0131l\u0131 r\u0131zas\u0131yla m\u00fcmk\u00fcnd\u00fcr.<\/li>\n\n\n\n<li>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda alt kira ili\u015fkisinin kurulmas\u0131 kural olarak yasak olup aksinin kararla\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/li>\n\n\n\n<li>Kiralanan\u0131 yeni sat\u0131n alan malik, ayn\u0131 il\u00e7e s\u0131n\u0131rlar\u0131 i\u00e7erisinde ba\u015fkaca malik oldu\u011fu meskeni yoksa sat\u0131n alma tarihinden itibaren 1 ay i\u00e7inde kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 isteyebilir ancak bunun i\u00e7in kirac\u0131ya muhakkak 6 ay s\u00fcre vermelidir.<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n kira bedelini \u00f6dememesi durumunda kendisine 7 g\u00fcn i\u00e7inde kira borcunu \u00f6demesi aksi takdirde 30 g\u00fcn sonunda tahliye davas\u0131 a\u00e7\u0131laca\u011f\u0131na dair ihtarl\u0131 \u00f6deme emri g\u00f6nderilebilir. Bu durumda 30 g\u00fcn i\u00e7inde \u00f6deme ger\u00e7ekle\u015fmezse kirac\u0131n\u0131n tahliyesi i\u00e7in mahkemeye ba\u015fvurulur.<\/li>\n\n\n\n<li>Kiralanan\u0131n geri verilmesi esnas\u0131nda kiralayan derhal kontrolde bulunur ve eksik\/kusur varsa derhal kirac\u0131ya bildirir.
