Kamula\u015ft\u0131rma i\u015flemleri tamamlanmam\u0131\u015f veya kamula\u015ft\u0131rmas\u0131 hi\u00e7 yap\u0131lmam\u0131\u015f olmas\u0131na ra\u011fmen 9\/10\/1956 tarihi ile 4\/11\/1983 tarihi aras\u0131nda fiilen kamu hizmetine ayr\u0131lan veya kamu yarar\u0131na ili\u015fkin bir ihtiyaca tahsis edilerek \u00fczerinde tesis yap\u0131lan ta\u015f\u0131nmazlara veya kaynaklara k\u0131smen veya tamamen veyahut irtifak hakk\u0131 tesis etmek suretiyle malikin r\u0131zas\u0131 olmaks\u0131z\u0131n fiili olarak el konulmas\u0131 sebebiyle, m\u00fclkiyet hakk\u0131ndan do\u011fan talepler, bedel talep edilmesi h\u00e2linde bedel tespiti ve di\u011fer i\u015flemler bu madde h\u00fck\u00fcmlerine g\u00f6re yap\u0131l\u0131r. Bu maddeye g\u00f6re yap\u0131lacak i\u015flemlerde \u00f6ncelikle uzla\u015fma usul\u00fcn\u00fcn uygulanmas\u0131 dava \u015fart\u0131d\u0131r. \u0130darenin daveti veya malikin m\u00fcracaat\u0131 \u00fczerine, fiilen el konulan ta\u015f\u0131nmaz\u0131n veya \u00fczerinde tesis edilen irtifak hakk\u0131n\u0131n idarenin daveti veya malikin m\u00fcracaat etti\u011fi tarihteki tahmini de\u011feri; bu Kanunun 8 inci maddesinin ikinci f\u0131kras\u0131na g\u00f6re te\u015fkil edilen k\u0131ymet takdir komisyonu marifetiyle, ta\u015f\u0131nmaz\u0131n el koyma tarihindeki nitelikleri esas al\u0131nmak ve bu Kanunun 11 inci ve 12 nci maddelerine g\u00f6re hesaplanmak suretiyle tespit edilir. Tespitten sonra, bu Kanunun 8 inci maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na g\u00f6re te\u015fkil olunan uzla\u015fma komisyonunca, idarenin daveti veya malikin m\u00fcracaat tarihinden itibaren en ge\u00e7 alt\u0131 ay i\u00e7inde 7201 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine g\u00f6re tebli\u011f edilen bir yaz\u0131 ile, tahmini de\u011fer bildirilmeksizin, talep sahibi uzla\u015fma g\u00f6r\u00fc\u015fmelerine davet edilir. 24\/52013 tarihli ve 6487 say\u0131l\u0131 Kanunun 21 inci maddesi ile bu maddenin ba\u015fl\u0131\u011f\u0131 \u201cKamula\u015ft\u0131rmas\u0131z el koyma sebebiyle tazmin\u201d iken metne i\u015flendi\u011fi \u015fekilde de\u011fi\u015ftirilmi\u015ftir. 6218-2 Uzla\u015fma; idareye ait ta\u015f\u0131nmaz\u0131n trampas\u0131, idareye ait ta\u015f\u0131nmaz \u00fczerinde s\u0131n\u0131rl\u0131 ayni hak tan\u0131nmas\u0131 veya imar mevzuat\u0131 \u00e7er\u00e7evesinde ba\u015fka bir yerde imar hakk\u0131 kulland\u0131r\u0131lmas\u0131 suretiyle veya bunlar\u0131n m\u00fcmk\u00fcn olmamas\u0131 h\u00e2linde nakdi bedel \u00fczerinden yap\u0131labilir. Uzla\u015fma g\u00f6r\u00fc\u015fmeleri, hukuki veya fiili engel bulunmad\u0131\u011f\u0131 takdirde davete icabet tarihinden itibaren en ge\u00e7 alt\u0131 ay i\u00e7inde sonu\u00e7land\u0131r\u0131l\u0131r ve uzla\u015fmaya var\u0131l\u0131p var\u0131lmad\u0131\u011f\u0131, malik veya temsilcisi ile komisyon \u00fcyeleri taraf\u0131ndan imzalanan bir tutana\u011fa ba\u011flan\u0131r. Bu tutanak ile uzla\u015fma g\u00f6r\u00fc\u015fmelerine ili\u015fkin bilgi ve belgeler, a\u00e7\u0131lacak davalarda taraflar aleyhine delil te\u015fkil etmez. Uzla\u015fmaya var\u0131lmas\u0131 h\u00e2linde, \u00fczerinde uzla\u015f\u0131lan hakk\u0131n t\u00fcr\u00fcn\u00fc, tan\u0131nma \u015fart ve usullerini, nakdi \u00f6demede bulunulacak ise miktar\u0131n\u0131 ve \u00f6deme \u015fartlar\u0131 ile ta\u015f\u0131nmazlar\u0131n tesciline veya terkinine dair muvafakati de ihtiva eden bir s\u00f6zle\u015fme akdedilerek bu s\u00f6zle\u015fme \u00e7er\u00e7evesinde i\u015flem yap\u0131l\u0131r ve uzla\u015fma konusu ta\u015f\u0131nmazlar resen tapuya tescil veya terkin edilir. Uzla\u015f\u0131lan bedel, b\u00fct\u00e7e imkanlar\u0131 d\u00e2hilinde sonraki y\u0131llara s\u00e2ri olacak \u015fekilde taksitli olarak da \u00f6denebilir. Taksitli \u00f6deme s\u00fcresince, 4\/12\/1984 tarihli ve 3095 say\u0131l\u0131 Kanuni Faiz ve Temerr\u00fct Faizine \u0130li\u015fkin Kanuna g\u00f6re ayr\u0131ca kanuni faiz \u00f6denir. \u0130dare ve malik aras\u0131nda uzla\u015fma sa\u011flanamad\u0131\u011f\u0131 takdirde, uzla\u015fmazl\u0131k tutana\u011f\u0131n\u0131n tanzim edildi\u011fi tarihten itibaren \u00fc\u00e7 ay i\u00e7inde malik veya idare taraf\u0131ndan bedel tespiti davas\u0131 a\u00e7\u0131labilir. Dava a\u00e7\u0131lmas\u0131 h\u00e2linde, fiilen el konulan ta\u015f\u0131nmaz\u0131n veya \u00fczerinde tesis edilen irtifak hakk\u0131n\u0131n dava tarihindeki de\u011feri, ikinci f\u0131kran\u0131n birinci c\u00fcmlesindeki esaslara g\u00f6re mahkemece bu Kanunun 15 inci maddesine g\u00f6re bilirki\u015fi incelemesi yap\u0131lmak suretiyle tespit ve ta\u015f\u0131nmaz\u0131n veya hakk\u0131n idare ad\u0131na tesciline veya terkinine h\u00fckmedilir. Tespit edilen bedel, bu maddenin sekizinci f\u0131kras\u0131na g\u00f6re idarece \u00f6denir. Tescile veya terkine ili\u015fkin h\u00fck\u00fcm kesin olup taraflar\u0131n h\u00fckmedilen bedele ili\u015fkin temyiz hakk\u0131 sakl\u0131d\u0131r. Bu madde kapsam\u0131nda a\u00e7\u0131lan davalarda mahkeme ve icra har\u00e7lar\u0131 ile her t\u00fcrl\u00fc vekalet \u00fccretleri bedel tespiti davalar\u0131nda \u00f6ng\u00f6r\u00fclen \u015fekilde maktu olarak belirlenir. Kesinle\u015fen mahkeme kararlar\u0131na istinaden bu madde uyar\u0131nca \u00f6demelerde kullan\u0131lmak \u00fczere, ihtiya\u00e7 olmas\u0131 h\u00e2linde, merkezi y\u00f6netim b\u00fct\u00e7esine d\u00e2hil idarelerin y\u0131l\u0131 b\u00fct\u00e7elerinde sermaye giderleri i\u00e7in \u00f6ng\u00f6r\u00fclen \u00f6deneklerinin (Milli Savunma Bakanl\u0131\u011f\u0131, Jandarma Genel Komutanl\u0131\u011f\u0131 ve Sahil G\u00fcvenlik Komutanl\u0131\u011f\u0131 b\u00fct\u00e7elerinin g\u00fcvenlik ve savunmaya y\u00f6nelik mal ve hizmet al\u0131mlar\u0131 ile yap\u0131m giderleri i\u00e7in ayr\u0131lan \u00f6deneklerin) y\u00fczde ikisi, belediye ve il \u00f6zel idareleri ile ba\u011fl\u0131 idareleri i\u00e7in en son kesinle\u015fmi\u015f b\u00fct\u00e7e gelirleri toplam\u0131n\u0131n, di\u011fer idareler i\u00e7in en son kesinle\u015fmi\u015f b\u00fct\u00e7e giderleri toplam\u0131n\u0131n en az y\u00fczde ikisi oran\u0131nda y\u0131l\u0131 b\u00fct\u00e7elerinde pay ayr\u0131l\u0131r. Kesinle\u015fen alacaklar\u0131n toplam tutar\u0131n\u0131n ayr\u0131lan \u00f6dene\u011fin toplam tutar\u0131n\u0131 a\u015fmas\u0131 h\u00e2linde, \u00f6demeler, sonraki y\u0131llara s\u00e2ri olacak \u015fekilde, garameten ve taksitlerle ger\u00e7ekle\u015ftirilir. Taksitlendirmede, b\u00fct\u00e7e imk\u00e2nlar\u0131 ile alacaklar\u0131n tutarlar\u0131 dikkate al\u0131n\u0131r. Taksitli \u00f6deme s\u00fcresince, 3095 say\u0131l\u0131 Kanuna g\u00f6re ayr\u0131ca kanuni faiz \u00f6denir. \u0130dare taraf\u0131ndan, mahkeme karar\u0131 gere\u011fince nakdi \u00f6deme yerine, \u00fc\u00e7\u00fcnc\u00fc f\u0131krada belirtilen di\u011fer uzla\u015fma yollar\u0131 da teklif edilebilir ve bu maddenin uzla\u015fmaya ili\u015fkin h\u00fck\u00fcmlerine g\u00f6re i\u015flem yap\u0131labilir. 6218-3 Bu maddenin bedele ili\u015fkin h\u00fck\u00fcmleri, vuku buldu\u011fu tarih itibar\u0131 ile bu maddenin kapsam\u0131nda olan kamula\u015ft\u0131rmas\u0131z el koymadan dolay\u0131 a\u00e7t\u0131klar\u0131 tazminat davas\u0131 s\u00fcre bak\u0131m\u0131ndan dava hakk\u0131n\u0131n d\u00fc\u015ft\u00fc\u011f\u00fc gerek\u00e7esiyle reddedilmi\u015f olanlar hakk\u0131nda da uygulan\u0131r. Evvelce a\u00e7t\u0131klar\u0131 davalar sonunda tazminat almaya hak kazanm\u0131\u015f veya s\u00fcre d\u0131\u015f\u0131ndaki sebeplerden dolay\u0131 davalar\u0131 reddedilmi\u015f olanlar hakk\u0131nda bu madde h\u00fck\u00fcmleri uygulanmaz. Ancak, gerek i\u00e7 hukuka ve gerekse milletleraras\u0131 hukuka g\u00f6re evvelce a\u00e7t\u0131klar\u0131 davalar sonunda hak kazanm\u0131\u015f olduklar\u0131 tazminat hen\u00fcz \u00f6denmemi\u015f olanlara, idare taraf\u0131ndan nakdi \u00f6deme yerine, \u00fc\u00e7\u00fcnc\u00fc f\u0131krada belirtilen di\u011fer uzla\u015fma yollar\u0131 teklif edilebilir ve bu maddenin uzla\u015fmaya ili\u015fkin h\u00fck\u00fcmlerine g\u00f6re i\u015flem yap\u0131labilir. Vuku buldu\u011fu tarih itibar\u0131 ile bu maddenin kapsam\u0131nda olan kamula\u015ft\u0131rmas\u0131z el koymadan dolay\u0131 bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girmesinden \u00f6nce tazmin talebiyle dava a\u00e7m\u0131\u015f olanlar; bu madde h\u00fck\u00fcmlerine g\u00f6re uzla\u015fma yoluna gitmeyi isteyip istemediklerini bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girmesinden itibaren \u00fc\u00e7 ay i\u00e7inde idareye ve mahkemeye verecekleri dilek\u00e7eler ile bildirebilirler. Uzla\u015fma talebi \u00fczerine, uzla\u015fma g\u00f6r\u00fc\u015fmelerinin neticesine kadar dava bekletilir; uzla\u015f\u0131lamamas\u0131 h\u00e2linde, uzla\u015fmazl\u0131k tutana\u011f\u0131n\u0131n mahkemeye sunulmas\u0131ndan sonra davaya devam edilir. (M\u00fclga \u00fc\u00e7\u00fcnc\u00fc c\u00fcmle: 20\/8\/2016-6745\/34 md.) Bu madde h\u00fck\u00fcmleri karara ba\u011flanmam\u0131\u015f veya karar\u0131 kesinle\u015fmemi\u015f t\u00fcm davalara uygulan\u0131r. Karar\u0131 kesinle\u015fen davalara ise, bu maddenin yaln\u0131zca sekizinci f\u0131kra h\u00fck\u00fcmleri uygulan\u0131r. Bu madde uyar\u0131nca \u00f6denecek olan bedelin tahsili sebebiyle idarelerin mal, hak ve alacaklar\u0131 haczedilemez.<\/p>\n\n\n\n<p><strong><u>2) \u0130DAREN\u0130N 5 YIL \u0130\u00c7\u0130NDE \u0130MAR PLANININ GERE\u011e\u0130N\u0130 YAPMASINA DA\u0130R BA\u011eLAYICI YARGITAY HUKUK GENEL KURULU KARARI<\/u><\/strong><\/p>\n\n\n\n<p>T.C. YARGITAY HUKUK GENEL KURULU E. 2010\/5-662 K. 2010\/651 T. 15.12.2010<\/p>\n\n\n\n<p>\u00d6ZET : Kamula\u015ft\u0131rmas\u0131z el atma nedeniyle tazminat davas\u0131nda, dava tarihine kadar yirmi y\u0131l\u0131 ge\u00e7en s\u00fcre\u00e7 i\u00e7erisinde davac\u0131, ta\u015f\u0131nmaz\u0131n kamula\u015ft\u0131r\u0131lmas\u0131 ya da tahsis amac\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lmas\u0131 talebiyle yapt\u0131\u011f\u0131 ba\u015fvurulardan olumlu bir sonu\u00e7 alamam\u0131\u015ft\u0131r. Belediye Ba\u015fkanl\u0131\u011f\u0131 imar plan\u0131n\u0131n y\u00fcr\u00fcrl\u00fck tarihinden itibaren en ge\u00e7 3 ay i\u00e7erisinde plan\u0131n tatbiki i\u00e7in 5 y\u0131ll\u0131k imar program\u0131n\u0131 haz\u0131rlamakla y\u00fck\u00fcml\u00fcd\u00fcr. Uzun y\u0131llar programa al\u0131nmayan imar plan\u0131n\u0131n fiilen hayata ge\u00e7irilmemesi nedeniyle kamula\u015ft\u0131rma ya da takas cihetine gitmeyen daval\u0131 \u0130darece, pasif ve suskun kal\u0131nmak ve i\u015flem tesis edilmemek suretiyle ta\u015f\u0131nmaza m\u00fcdahale edildi\u011fi a\u00e7\u0131kt\u0131r. Yerel Mahkemece, kamula\u015ft\u0131rmas\u0131z el koyma olgusunun varl\u0131\u011f\u0131n\u0131n kabul\u00fcyle, daval\u0131 \u0130darenin kamula\u015ft\u0131rmas\u0131z el koyma h\u00fck\u00fcmleri do\u011frultusunda sorumlu bulundu\u011funa ili\u015fkin direnme karar\u0131 yerindedir.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><u>5 YILLIK S\u00dcREN\u0130N 2016 YILINDA BA\u015eLAYACA\u011eINA DA\u0130R KANUN D\u00dcZENLEMES\u0130NDEN SONRAK\u0130 DURUM<\/u><\/strong><\/li>\n<\/ul>\n\n\n\n<p>Uygulamada, Asliye Hukuk Mahkemelerinde a\u00e7\u0131lan davalarda; 1\/1000 lik uygulama imar planlar\u0131nda resmi yap\u0131, okul, cami, yol, meydan gibi umumi hizmetlere ayr\u0131lan yerlerin 5 y\u0131l i\u00e7inde amac\u0131na uygun \u015fekilde kamula\u015ft\u0131r\u0131lmas\u0131n\u0131n yap\u0131lmamas\u0131 durumunda bu kamula\u015ft\u0131rmas\u0131z el atma say\u0131lmakta ve Kamula\u015ft\u0131rma Kanunu h\u00fck\u00fcmlerine g\u00f6re ta\u015f\u0131nmaz\u0131n bedeli kadar tazminata ve tapunun iptali ile daval\u0131 idare ad\u0131na tesciline karar verilmekteydi. S\u00f6z konusu 15.12.2010 tarihli HGK karar\u0131ndan sonra bu durum uygulamada i\u00e7tihatlarla hukuka ve hakkaniyete uygun bir \u015fekilde istikrar kazanm\u0131\u015fken, belediyelerin y\u00fckl\u00fc miktarda tazminat \u00f6demek durumunda kalmas\u0131 ve bu durumun b\u00fct\u00e7elerini ciddi bir \u015fekilde zorlamas\u0131 ile bu davalar\u0131 kendileri a\u00e7\u0131s\u0131nda b\u00fcy\u00fck bir risk ve alt\u0131ndan kalmayacaklar\u0131 bir tehdit olarak g\u00f6rmeleri nedeniyle kamuoyunda 3. Yarg\u0131 paketi olarak bilinen 24 May\u0131s 2013 tarihinde TBMM\u2019de kabul edilen 6487 say\u0131l\u0131 torba yasayla kamula\u015ft\u0131rma hukukunda evrensel hukuk normlar\u0131na uygunlu\u011fu \u00e7ok tart\u0131\u015f\u0131lan temel d\u00fczenlemeler getirilmesini sa\u011flam\u0131\u015flard\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><u>5 YILLIK S\u00dcREN\u0130N 2016 YILINDA BA\u015eLAYACA\u011eINI \u00d6N G\u00d6REN KANUN\u0130 D\u00dcZENLEMEY\u0130 \u0130PTAL EDEN ANAYASA MAHKEMES\u0130 KARARI<\/u><\/strong><\/li>\n<\/ul>\n\n\n\n<p>Anayasa Mahkemesi 28\/3\/2018 tarihli toplant\u0131s\u0131nda&nbsp;<a href=\"http:\/\/www.anayasa.gov.tr\/icsayfalar\/basin\/kararlarailiskinbasinduyurulari\/genelkurul\/detay\/pdf\/2018-34.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>E.2016\/196<\/strong><\/a>&nbsp;numaral\u0131 dosyada 4\/11\/1983 tarihli ve 2942 say\u0131l\u0131 Kamula\u015ft\u0131rma Kanunu\u2019na, 20\/8\/2016 tarihli ve 6745 say\u0131l\u0131 Kanun\u2019un 34. maddesiyle eklenen ge\u00e7ici 11. maddenin iptaline karar vermi\u015ftir.<\/p>\n\n\n\n<p><strong><em>\u0130tiraz Konusu Kural<\/em><\/strong><em><\/em><\/p>\n\n\n\n<p>3\/5\/1985 tarihli ve 3194 say\u0131l\u0131 \u0130mar Kanunu\u2019nun 18. maddesinde, d\u00fczenleme ortakl\u0131k paylar\u0131n\u0131n toplam\u0131n\u0131n umumi hizmetler i\u00e7in ayr\u0131lmas\u0131 gereken yerlerin alanlar\u0131 toplam\u0131ndan az oldu\u011fu takdirde eksik kalan miktar\u0131n belediye veya valilik\u00e7e kamula\u015ft\u0131rma yolu ile tamamlanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>Ayn\u0131 Kanun\u2019un 10. maddesinde kamu hizmetine tahsis edilmi\u015f olan b\u00f6yle yerlerin ilgili kamu kurulu\u015flar\u0131nca be\u015f y\u0131l i\u00e7inde kamula\u015ft\u0131r\u0131laca\u011f\u0131 ve bu ama\u00e7la gerekli \u00f6dene\u011fin kurulu\u015flar\u0131n y\u0131ll\u0131k b\u00fct\u00e7elerine konulaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>2942 say\u0131l\u0131 Kanun\u2019un ek 1. maddesinde, be\u015f y\u0131ll\u0131k s\u00fcrenin uygulama imar planlar\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesinden itibaren ba\u015flayaca\u011f\u0131 d\u00fczenlenmi\u015ftir. Bu maddeyle idareye, bu s\u00fcre i\u00e7inde tasarrufu hukuken k\u0131s\u0131tlanan ta\u015f\u0131nmazlar\u0131 kamula\u015ft\u0131rma veya m\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131na engel te\u015fkil edecek k\u0131s\u0131tl\u0131l\u0131\u011f\u0131 kald\u0131racak \u015fekilde imar plan\u0131 de\u011fi\u015fikli\u011fi yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilmi\u015ftir. Bu s\u00fcre i\u00e7inde belirtilen i\u015flemlerin yap\u0131lmamas\u0131 h\u00e2linde ta\u015f\u0131nmaz malikleri taraf\u0131ndan idareye ba\u015fvuru i\u015flemleri ve uzla\u015ft\u0131rma s\u00fcreci tamamland\u0131ktan sonra ta\u015f\u0131nmaz\u0131n kamula\u015ft\u0131r\u0131lmas\u0131ndan sorumlu idare aleyhine dava a\u00e7\u0131labilece\u011fi belirtilmi\u015ftir.<\/p>\n\n\n\n<p>Ayn\u0131 Kanun\u2019un itiraz konusu ge\u00e7ici 11. maddesinde ise ek 1. madde kapsam\u0131nda kalan ve bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce tasarrufu hukuken k\u0131s\u0131tlanan ta\u015f\u0131nmazlar bak\u0131m\u0131ndan s\u00f6z konusu be\u015f y\u0131ll\u0131k s\u00fcrenin bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren ba\u015flayaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu be\u015f y\u0131ll\u0131k s\u00fcrenin dolmas\u0131, imar yoluyla el atma i\u015flemlerine kar\u015f\u0131 dava a\u00e7\u0131labilmesi i\u00e7in bir \u00f6n ko\u015ful olarak d\u00fczenlenmi\u015ftir. \u0130tiraz konusu kural\u0131n ikinci f\u0131kras\u0131nda bu Kanun\u2019un ek 1. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 h\u00fckm\u00fcn\u00fcn bu madde kapsam\u0131nda kalan ta\u015f\u0131nmazlara ili\u015fkin dava ve takipler hakk\u0131nda da uygulanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>\u0130tiraz konusu kural, y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nceki k\u0131s\u0131tl\u0131l\u0131k s\u00fcrelerinin dikkate al\u0131nmamas\u0131 sonucunu do\u011furmaktad\u0131r. Dolay\u0131s\u0131yla bu d\u00fczenleme, zaten k\u0131s\u0131tl\u0131l\u0131\u011f\u0131 devam eden ta\u015f\u0131nmazlar y\u00f6n\u00fcnden Kanun\u2019un ek 1. maddesiyle maliklere tan\u0131nan idareye ba\u015fvuru ve idari yarg\u0131da dava a\u00e7ma hakk\u0131n\u0131n kullan\u0131labilmesi i\u00e7in ge\u00e7mesi gereken be\u015f y\u0131ll\u0131k s\u00fcreyi yeniden ba\u015flatmaktad\u0131r.<\/p>\n\n\n\n<p><strong><em>Ba\u015fvuru Gerek\u00e7eleri<\/em><\/strong><em><\/em><\/p>\n\n\n\n<p>Ba\u015fvuru kararlar\u0131nda, derdest olan davalar\u0131n esas\u0131 hakk\u0131nda karar verilmesini engelleyen ve m\u00fclkiyet hakk\u0131 \u00fczerindeki k\u0131s\u0131tlamalar\u0131n daha uzun s\u00fcrmesine yol a\u00e7an itiraz konusu kural\u0131n m\u00fclkiyet hakk\u0131n\u0131, hak arama h\u00fcrriyetini ve hukuk devleti ilkesini zedeledi\u011fi ve Anayasa\u2019n\u0131n 2., 5., 9., 35. ve 36. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p><strong><em>Mahkemenin De\u011ferlendirmesi<\/em><\/strong><em><\/em><\/p>\n\n\n\n<p>\u0130mar planlar\u0131 onaylanarak idare ve bireyler a\u00e7\u0131s\u0131ndan hukuki sonu\u00e7lar do\u011furmaktad\u0131r. \u0130mar planlar\u0131n\u0131n onaylanmas\u0131ndan sonra \u00f6zellikle imarl\u0131 alan i\u00e7inde bulunulacak her t\u00fcrl\u00fc imar ve yap\u0131 faaliyetlerinde imar plan ve programlar\u0131na uygun davranma, her t\u00fcrl\u00fc yap\u0131 i\u00e7in ilgili idareden izin alma ve izin ilkelerine uygun olarak yap\u0131 in\u015fa etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc do\u011fmaktad\u0131r. Bunun yan\u0131nda ta\u015f\u0131nmaz\u0131n imar plan\u0131nda kamu hizmetine ayr\u0131lmas\u0131 hen\u00fcz bir kamula\u015ft\u0131rma yap\u0131lmay\u0131p fiilen de ta\u015f\u0131nmaza el at\u0131lmad\u0131\u011f\u0131 i\u00e7in m\u00fclkiyet hakk\u0131n\u0131 ortadan kald\u0131rmamakla birlikte malikin m\u00fclkiyet hakk\u0131ndan do\u011fan yetkilerini \u00f6nemli \u00f6l\u00e7\u00fcde k\u0131s\u0131tlamaktad\u0131r. Bu kapsamda kamu hizmet alan\u0131 olarak ayr\u0131lmas\u0131ndan dolay\u0131 ta\u015f\u0131nmaz \u00fczerinde in\u015fai faaliyette bulunulabilmesi m\u00fcmk\u00fcn olamad\u0131\u011f\u0131 gibi bu durumun sat\u0131\u015f, ba\u011f\u0131\u015f, ipotek ve di\u011fer irtifak haklar\u0131n\u0131n tesisi y\u00f6n\u00fcnden yap\u0131lacak i\u015flemler ve ta\u015f\u0131nmaz\u0131n rayi\u00e7 de\u011feri bak\u0131m\u0131ndan da olumsuz etkileri bulunmaktad\u0131r. Dolay\u0131s\u0131yla imar uygulamalar\u0131n\u0131n ve bu ba\u011flamda ta\u015f\u0131nmazlar\u0131n imar durumunun kamu hizmet alan\u0131 olarak belirlenmesinin m\u00fclkiyet hakk\u0131na m\u00fcdahale te\u015fkil etti\u011fi ku\u015fkusuzdur.<\/p>\n\n\n\n<p>Anayasa\u2019n\u0131n 35. maddesinde m\u00fclkiyet hakk\u0131 s\u0131n\u0131rs\u0131z bir hak olarak d\u00fczenlenmemi\u015f, bu hakk\u0131n kamu yarar\u0131 amac\u0131yla ve kanunla s\u0131n\u0131rland\u0131r\u0131labilece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. M\u00fclkiyet hakk\u0131na m\u00fcdahalede bulunulurken temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin genel ilkeleri d\u00fczenleyen Anayasa\u2019n\u0131n 13. maddesinin de g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Anayasa\u2019n\u0131n 35. maddesi uyar\u0131nca m\u00fclkiyet hakk\u0131 ancak kamu yarar\u0131 amac\u0131yla s\u0131n\u0131rlanabilir. \u0130mar planlar\u0131yla arazi ve arsa d\u00fczenlemesi s\u0131ras\u0131nda ta\u015f\u0131nmazlar\u0131n bir k\u0131sm\u0131n\u0131n kamu hizmetine ayr\u0131lmas\u0131n\u0131n kamu yarar\u0131 amac\u0131na d\u00f6n\u00fck oldu\u011fu ku\u015fkusuzdur.<\/p>\n\n\n\n<p>\u0130tiraz konusu kuralla m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin kamu yarar\u0131 amac\u0131na d\u00f6n\u00fck olmas\u0131 yeterli olmay\u0131p ayr\u0131ca \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r.<\/p>\n\n\n\n<p>D\u00fczenli ve planl\u0131 bir kentle\u015fmenin sa\u011flanabilmesi amac\u0131na y\u00f6nelik olarak arsa ve arazi d\u00fczenlemesi yap\u0131lmas\u0131n\u0131n ve bu kapsamda kamu hizmetleri i\u00e7in ihtiya\u00e7 duyulan ta\u015f\u0131nmazlar\u0131n kamu hizmetine ayr\u0131lmas\u0131n\u0131n itiraz konusu kural bak\u0131m\u0131ndan elveri\u015fsiz bir ara\u00e7 oldu\u011fu s\u00f6ylenemez. Di\u011fer taraftan sosyal birer varl\u0131k olarak ayn\u0131 yerle\u015fim yerinde ve bir arada ya\u015fayan bireylerin bu ihtiya\u00e7lar\u0131n\u0131n giderilmesi, \u00f6zel m\u00fclkiyette bulunmayan kamusal birtak\u0131m alanlar\u0131n varl\u0131\u011f\u0131n\u0131 gerekli h\u00e2le getirmektedir. Dolay\u0131s\u0131yla kamu yarar\u0131 amac\u0131yla imar uygulamas\u0131nda ta\u015f\u0131nmazlar\u0131n kamu hizmeti alanlar\u0131na ayr\u0131lmas\u0131 suretiyle itiraz konusu kural kapsam\u0131nda m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin gerekli olmad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n\n\n\n<p>\u0130tiraz konusu kuralla m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin orant\u0131l\u0131 olup olmad\u0131\u011f\u0131 da incelenmelidir. \u00d6zel m\u00fclkiyette bulunan ta\u015f\u0131nmazlar\u0131n imar uygulamas\u0131nda kamu hizmeti alan\u0131 olarak ayr\u0131lmas\u0131 yoluyla malike a\u015f\u0131r\u0131 ve orant\u0131s\u0131z bir k\u00fclfet y\u00fcklenmemelidir.<\/p>\n\n\n\n<p>\u0130mar uygulamalar\u0131n\u0131n geni\u015f alanlar\u0131 kapsamas\u0131 nedeniyle ve b\u00fct\u00e7eye yeterli \u00f6dene\u011fin konulmas\u0131 amac\u0131yla kanun koyucu kamula\u015ft\u0131rma s\u00fcrecinin be\u015f y\u0131ll\u0131k s\u00fcre i\u00e7inde tamamlanmas\u0131n\u0131 \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr. M\u00fclkiyetin kontrol\u00fcne ili\u015fkin s\u00f6z konusu m\u00fcdahaleler bak\u0131m\u0131ndan kanun koyucunun takdir yetkisi bulunmaktad\u0131r. Bu takdir yetkisi \u00e7er\u00e7evesinde s\u00f6z konusu kamu yarar\u0131 amac\u0131n\u0131n ger\u00e7ekle\u015ftirilmesi y\u00f6n\u00fcnden belirtilen fiil\u00ee ve hukuki engeller sebebiyle malikin makul ve belirli bir s\u00fcre boyunca bu k\u0131s\u0131tlamalara katlanmas\u0131 beklenebilir. Ancak bu s\u00fcrenin uzamas\u0131 h\u00e2linde s\u00f6z konusu k\u0131s\u0131tlamalar, ta\u015f\u0131nmaz malikine y\u00fcklenen k\u00fclfeti a\u011f\u0131rla\u015ft\u0131raca\u011f\u0131 gibi k\u0131s\u0131tl\u0131l\u0131k s\u00fcresinin uzamas\u0131na ba\u011fl\u0131 olarak malikin zarar\u0131n\u0131 kar\u015f\u0131layabilecek herhangi bir giderim imk\u00e2n\u0131n\u0131n getirilmemesi de malike a\u015f\u0131r\u0131 bir k\u00fclfet y\u00fcklenmesine sebep olacakt\u0131r.<\/p>\n\n\n\n<p>\u0130tiraz konusu kuralda, imar uygulamas\u0131yla getirilen k\u0131s\u0131tl\u0131l\u0131k y\u00f6n\u00fcnden \u00f6ng\u00f6r\u00fclen be\u015f y\u0131ll\u0131k s\u00fcrenin maddenin y\u00fcr\u00fcrl\u00fck tarihinden itibaren yeniden ba\u015flamas\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ba\u015fka bir ifadeyle m\u00fclkiyet hakk\u0131ndan diledi\u011fi gibi tasarruf edebilmesi ve yararlanabilmesi k\u0131s\u0131tlanan malikin kamula\u015ft\u0131rma bedeline kavu\u015fabilmesi veya s\u00f6z konusu k\u0131s\u0131tl\u0131l\u0131k h\u00e2linin kald\u0131r\u0131larak m\u00fclkiyet hakk\u0131ndan yararlanabilmesi i\u00e7in ge\u00e7mesi gereken be\u015f y\u0131ll\u0131k s\u00fcrenin yeniden ba\u015flamas\u0131 s\u00f6z konusu olmaktad\u0131r. Kanun koyucu bu s\u00fcre nedeniyle malikin u\u011frad\u0131\u011f\u0131 zararlar\u0131 telafi etmeye veya gidermeye y\u00f6nelik herhangi bir d\u00fczenleme ise getirmemi\u015ftir. \u00dcstelik bu k\u0131s\u0131tl\u0131l\u0131k nedeniyle a\u00e7\u0131lacak davalarda ta\u015f\u0131nmaz\u0131 kullanamamaktan do\u011fan zararlar\u0131n tazminine y\u00f6nelik bir d\u00fczenleme mevcut olmad\u0131\u011f\u0131 gibi itiraz konusu kural, y\u00fcr\u00fcrl\u00fck tarihinden \u00f6nceki k\u0131s\u0131tl\u0131l\u0131k s\u00fcrelerinin de dikkate al\u0131nmamas\u0131na yol a\u00e7maktad\u0131r. Bu durum ise malike a\u015f\u0131r\u0131 bir k\u00fclfet y\u00fcklemekte ve kamu yarar\u0131 ile malikin m\u00fclkiyet hakk\u0131 aras\u0131nda g\u00f6zetilmesi gereken adil dengeyi malik aleyhine bozmaktad\u0131r. Dolay\u0131s\u0131yla itiraz konusu kuralla m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahale orant\u0131l\u0131 de\u011fildir.<\/p>\n\n\n\n<p>Anayasa Mahkemesi, a\u00e7\u0131klanan gerek\u00e7elerle Anayasa\u2019n\u0131n 13. ve 35. maddelerine ayk\u0131r\u0131 bulunan itiraz konusu kural\u0131n birinci f\u0131kras\u0131n\u0131n ve bu f\u0131kran\u0131n iptali nedeniyle uygulanma olana\u011f\u0131 kalmayan ikinci f\u0131kras\u0131n\u0131n iptaline karar vermi\u015ftir.<\/p>\n\n\n\n<p>6487 say\u0131l\u0131 Kanunun 21. maddesi ile de\u011fi\u015fik 2942 say\u0131l\u0131 kanun ge\u00e7ici 6. maddesinin 10. f\u0131kras\u0131 h\u00fckm\u00fc; \u201c..Uygulama imar planlar\u0131nda umumi hizmetlere ve resmi kurumlara ayr\u0131lmak suretiyle veya ilgili kanunlar\u0131n uygulamas\u0131yla tasarrufu k\u0131s\u0131tlanan ta\u015f\u0131nmazlar hakk\u0131nda, 3\/5\/1985 tarihli ve 3194 say\u0131l\u0131 \u0130mar Kanununda \u00f6ng\u00f6r\u00fclen idari ba\u015fvuru ve i\u015flemler tamamland\u0131ktan sonra idari yarg\u0131da dava a\u00e7\u0131labilir.
